£34 Default with Hutchison 3G, only just noticed it.

Hi all,

I have been working very hard to get my credit file up to a good standard for years now and I have only ever checked my file with Experian.

I have an outstanding CCJ which is due to expire in November this year and I thought this was the only negative thing left on my file.

But... lastnight I decided to open a noddle account and when I did I was shocked to see that I have a default for £34 with Hutchison 3G dated 02/06/2009. I remember that I had a dongle with them years ago but it never worked where I lived so I took it back to the store and thought the contract was cancelled... clearly not, although the default says satisfied I don't remember making any payment of £34 to them.

I am wondering whether I would be able to write to them and ask if they would remove it from my file but reading through lots of threads here that probably won't happen.

I am upset now as once the ccj dropped off my file in November I was going to try buy a car but I'm now wondering how much of an affect this default is going to have on me?

I haven't applied for any sort of credit for over 2 years now, I have a credit card with Vanquis with a £3000 limit and has a balance of £50 (I use this for fuel each month and then pay it off) I have never missed a payment on this, I have a phone contract which again I have never missed a payment with, I have my gas bill and my current account on my file too which are both fully up to date too. I don't have an overdraft and definitely live with in my means.

I was hoping someone could advise if there was anything I could say to Hutchison to try to get them to take the default off and if someone could tell me how much this satisfied default will affect my chances of being accepted for credit?

I know that credit scores are probably meaningless but on experian my score is 961 but doesn't show the £34 satisfied default and noddle have me as 3/5 showing both the saisfied default and the CCJ.

Any help will be very much appreciated.

    Dispute the default with them. Take them to the communications ombudsman. No one can tell you how badly it will affect you.

    Do you have any paperwork left from your contract for the dongle with Three?

    If so, read the terms that applied at the time and see what it says about cancelling. If you were in a rolling one month contract rather than a fixed term contract, then usually you have to pay for the following month as you have to give notice of your intention to cancel.

    You might be able to persuade them to get rid of it on the basis that they didn't make you aware you owed them money, and if they had you would have paid it immediately.

    Ultimately, depending on what your paperwork says, I think this is going to be up to Three's discretion.

    Unfortunately for me I don't have any of the paperwork, looks like I'm going to have to wait till next year for it to drop off my file :-(

    You don't need the details. As said Dispute the default with them. Take them to the communications ombudsman. The ombudsman will make them cough up the terms if needed.

  • I have emailed them tonight asking them to remove it as I have never been contacted to say that I was going to have a default registered and that I have them the dongle back the same week as it didn't work. It says they will be in touch within 72 hours so fingers crossed.

    Hi Modder,

    I had this scenario last year with an O2 account for something like £25. It was a final bill that I thought had been paid and I cancelled the direct debt. They claim Moorcroft debt agency sent lots of letters to me but after doing some research i found these agencies rarely bother for such small amounts. The thing that made my blood boil even more was I had taken out 2 additional O2 contracts since.

    I logged a call with O2 customer services to get it into the system and then got their standard sorry we are right you are wrong but have a nice life email. I got the email address of their managing director,pr director,chairman, my local mp, a Daily Mail journalist that had done a article on exactly this, the ombudsman and a few others and kept them in my replies detailing the amounts, what it was doing to us as a family and guess what, it was removed pretty sharpish.

    I'm not saying it will definitely work for you but I would kick up a biblical sh$$ storm, they seem to not like emails with directors, journalists and ombudsmen copied in on it.

    I have conducted a full review of your Three account, and unfortunately I am unable to amend the negative entries that have been applied. The information recorded shows a true and accurate reflection of how your account was managed.

    I would like to thank you for your patience while your concerns were being addressed and I trust that this clarifies the status of your account.

    This is complete rubbish, I am being done over here I think. I have written back to them asking for proof of all letters they have sent to me saying that I owed them money and proof that they were going to register a default in my name. I explained that I will be going to the ombudsman about the issue too if it isn't resolved.

    That must be a generic response they send out as I have a copy of exactly the same response.
    After I had contacted them regarding my 3 account.
    I came to the end of my contract and they kept billing me.
    Even though i'd not used the dongle in months.

    On the basis of this I will be sending another letter as its clear they are just trying to fob me off.

    I thought that may be the case too.

    On my next email I will be copying in everyone that Davis has suggested above.

    Surely they should still have proof if they have sent me any letters or emails etc
