Asda Direct - I can't believe this?
Comments
-
personally ASDA Direct has gone above what is required, They DO NOT have to sell you the items they can give you cash back, which is what they are doing with the added £50 vouchers for their mistake in not sending the items.0

£50 gift voucher from Asda?? I have to see this to believe it, and even then.. :shocked:0
-
Keep pushing ASDA and they will withdraw their goodwill offer and just refund you, therefore meeting their legal obligation . Snap their hand off.0

50 pound compensation?! That's actually a cracking result...
Sounds to me like you've seen an item which seemed "too good to be true", ordered it and there has been a genuine mistake on ASDA's end and so they've sent you what they thought was the correct item but it in fact wasn't.
I think that you MAY have known something like this and as such you kinda knew that there was a chance of them being physically unable to fulfill the correct order.
In instances where they can't fulfill the order they need to refund you as soon as possible. If customers kick off they generally get a voucher but only about 10 pound or so usually!
To get a 50 pound offer you may have been doing their head in a lot with your complaints. This is good in a way BUT you are now at risk of them rescinding their offer. Then what are you doing to do? Go to trading standards? Because they'll side with you when you decline a full refund plus 50 pound.......
They wouldn't side with you regardless by the way.
You've been a crank and you've won. Don't throw it away now

Another case of someone demanding something that is impossible. If they are oos they can hardly pluck the items out of thin air and send them to you. As said you have been offered more than you are entitled to so take it and move on with life.0

I'm guessing the 'misprice' adds up to WAY more than £50 and the OP had already flogged the extra 4 to half his mates...0

There could be a case for loss of bargain here if they still stock them. Unless it was an obvious misprice or something which could well give a valid defence. IE a £500 tv advertised for £50.
Not being sure how their comp anies are structured, it could be a store has them but not the online store which are separated.
Overall though I'm gobsmacked to be reading this. £50 compo seems really generous. Good on asda0 -
Exactly what arcon said. There COULD be a case for loss of bargain as items were sent - in theory that could mean the contract is concluded.
But the fight to prove that would be horrendous and quite possibly unsuccessful. The offer of £50 (from the VERY limited amount of information given) is amazing service from ASDA.One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.0 -

I thought contract was only concluded with the dispatch of the actual item.
So I buy a £1000 TV for £10, and they send me a TV. Contract concluded, they cant chase me for the £990.
If they send me a cuddly toy then they never sent the contracted item so no contract was concluded.
Anyway I expect any loss of bargain on item no1 (which may well be that £50 goodwill voucher...) was negated by the purchase a 2/3/4/5 which if it is a obvious mis price will be seen as trying to take advantage...0 -
Hence I used the words "could", in theory", and "that could mean" followed by "the fight to prove that would be horrendous"
Far too much info is missing to provide decent and accurate advice. One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.0
