default from 2010 only just showing on credit file

I hope you can help.

Back in 2009 I took out a mobile phone with o2. After about 3-4 months of having the contract I became seriously ill with mental health issues and had to stop working while I went through therapy. I was in negotiation with o2 at the time to reduce payments or do whatever I could in the cirumstances. During this time, o2 sold the debt to cabot and then refused to speak to me as they said their account was closed. I didnt hear much from cabot and at the time and what I did get I didn't action.

In the meantime I have moved house several times, but always ensured im on the electoral roll. I checked my credit file in 2012 and it was fine, only recently (within the last 6 months) has a default notice been added to my credit file, however it states the default is dated april 2010. Whilst I dont dispute the debt, and am now in a position to negotiate repayment. I dont think the default is fair, especially considering its only just appeared on my file and I was originally trying to sort things out with o2. I dont remember getting anything through the post... is there any way I can get the default removed?

  • Unlikely to get removed.

    Selling the account is an indicator of a default.

    You are lucky it's taken so long to appear.

    On the plus side, it will be gone 6 years from the default date.

    Paying it will help with credit applications and the older it gets the better.

    Take O2 to the ombudsman. If the ombudsman find in your favour then Cabot will not have an excuse to continue recording the default.

  • Talk to these people, although probably better in a formal complaint, in a letter. Question why your data has been processed so erratically and outside of the usual guidelines for reporting. State the background to the case - let them know you are willing to co-operate and pay the balance for full removal of the default, not to be marked as satisfied. Worth a try.
