BTW, the amount she will have received will be after ebay & paypal fees, but when the sale is reversed they get reversed too.

Technically she has to and should the OP take this to court they would enforce this. However it is up to the OP if she could be bothered to go down this route for the small cost of the return postage as its likely not worth the hassle.
It seems unlikely the seller will agree to this though as they're clearly dragging their heels a bit.
I'd probably allow the seller to resolve this but ensure you post it with some sort of signed delivery and don't let it get outside the 45 day date before you raise it with eBay, if required.0 -

The seller has finally given me her address and I have sent it today £3.90 which I am happy to swallow.
I have also opened up a case and she isn't too chuffed about that but I am only safeguarding myself and I don't know her from adam and because I have my suspicions that the jacket is a fake I'm not too sure I can trust her which is a shame because I have sold and purchased over 400 items and have never had any problems up till now but that's life I suppose!0 -

Technically she has to [refund return postage] and should the OP take this to court they would enforce this.
It never fails to amaze me
1/ Why/how ebay do not enforce the LAW of the land
2/ How familiar ebayers are with Ebay policy and totally disconnected with the law/morality
If ebay forced scammers to refund return fees at reurnees discretion (Special delivery £8) then it would teach them a very good lesson and cost them dearly - as it stands this same scam artist could keep selling it until someone buys her excuses - might even be the 6-7 time shes trued to offload itWhen will the "Edit" and "Quote" button get fixed on the mobile web interface?0 -
I'm not sure what the law says on return fees for individuals, as opposed to commercial sellers.0

Oh dear I am getting confused will have to speak to Ebay.
The seller messaged me last night to say that as I have 'held' back the payment she will not be able to refund me?! I replied saying that I do have the power to do so and that according to my Paypal accout the sum of £53 still shows as going from my account to hers and that it is probably something Ebay/Paypal do when a case has been opened.
She has responded saying that I will have to close the case, if not she will be unable to refund me?
I don't know if she is either a fraudster or being a naive newbie Ebayer??0 -
She's being cocky. Possibly thinks you don't know the rules.
If you feel like being polite give her the ebay free phone number and tell her to ring them.
I take it she hadn't responded in the case? I'd tell her only to respond to you through the case now. I'd add these conversations to the case too.
I think ebay freeze the money until she's responded to the case and sorted it out.
I guess it's so she can't transfer the money out.
Don't forget she already was given the opportunity once to refund you and refused, that's why you've opened the case.
I had a similar issue with someone who sold me a fake, I let the case run it's course, she didn't respond and I got my refund and I got to keep,the item( I gave it to charity)0
