so im currently a t-mobile customer and 2 years has passed and i'm eligible for my early upgrade.

my contract ends on 19th October and i rang them for an early upgrade and i was offered the S5 for £41.00 a month!

i quoted 3rd party sites offering the phone for £28 a month but there was nothing he could do, where is the retention offers?

looks like ill be cancelling, three offer the best prices at the moment.

You wont get a good deal from an early upgrade. You probably wont get a good one from the upgrades department anyway. You need to wait until you are in your notice period (or after your minimum term) and either request your PAC or give notice to cancel. Retentions will then phone you.

An example of how crap EE upgrades are:
I have a T-Mobile sim only. I can upgrade or cancel any time now. I looked at the upgrade deals and they are pretty bad. I spoke to upgrades on the phone as well. The deals are SO bad it would be cheaper for me to get an S5 on vodafone from CPW, Unlock the phone (if its even locked, the only smartphone i have ever had from VF that was locked was an iPhone. I have had sony and samsungs that have not been locked), Bin the VF sim and continue to use my existing T-Mobile sim. Therefore paying 2 contracts (one vodafone that i would never use and the T-Mobile one).

That's why they do early upgrade. Offer a poor deal, get you to sign up for two years at a higher price than you otherwise would, all because instant gratification wants a shiny new object today and not next month!

Find the best deal and if EE won't match it (they probably won't) when you're in the last 30 days, get your PAC.

just phoned to cancel my contract, they said its £26.00 to cancel (im on £22 month contract) or i could wait until 19th and cancel for free

am i correct that there wont be any further charges once i have paid this cancellation fee? am i still billed for my monthly or no?

The money they are quoting is not a 'cancellation fee'. They cant charge you a cancellation fee. If you give notice now the charge will cover the period of either a 30 day notice (if the service termination date is after your minimum term date) OR the remainder of your contract costs up to that minimum term date.

As the amount is slightly more than your monthly payments i am guessing the termination date will be a week (ish) before your minimum term date. The customer service person misled you slightly. If you wait then it wont be 'free'. You will be charged for a months notice which in your case would be £22.

BUT to give a direct answer to your question the answer is yes. That is all you need to pay then you are clear.

    thanks for your reply.

im billed on the 19th every month hence my contract expires on the 19th october, i think i may just pay the £26 and move onto a new contract somewhere else. will still have my sim active for another 30 days

would i be able to claim my pac code at the same time and register for a new contract somewhere else straight away?

Your contract does not expire, just the minimum term, it becomes a 30 day notice rolling contract.

If you pay the £26 your contract terminates then and you may not be able to PAC your number out.

Typically no, you cannot have a notice to cancel and PAC code active at the same time. There is a risk the PAC may not be used in time, and your contract close so losing your number.

Request the PAC Code and find a new contract. Take that new contact out and give them the PAC code, and your account will close automaticaly when the code is used. You may still be charged a fee in lieu of notice, or if its before the minimum term.

If do not use the PAC code your account WILL continue, so if you change your mind on moving your number you need to call again and cancel the contract.

so basically instead of asking to cancel i should just ask for my pac code, find a new contract and let it automatically cancel, where it will charge me cancellation fee (hopefully no more than £26.00)

    Yes

If you ask to cancel, then ask for a PAC code the PAC code request overrides the cancel notice.

If you have not hit the minimum term you may be charged an early temination fee. And using a PAC gets to a charge of 30 days notice.

    So

You said your 2 years is up on the 19th of Oct. If you get and use a PAC now you'll be charged for a month and 14 days as an early termination fee.

If you wait until the 19th of Sep and use it you'll get charged a month early temination fee.

If you want to the 19th of Oct you'll be charged for a months fee instead of giving notice.

If you can plan to move on the 19th of September it should worl out the best, but anyway you have to pay for a month of service and get nothign for it, you may as well do it on the 19th of Sep to get pay the least possible.

if i cancel from now to the 19th sep its only a £3-4 difference? the quidco cashback from my new contract should cover off the fees i guess.

If you want to cancel then give notice and your contract will end in 30 days time but you will lose your number. You will get a final bill of £26 (unless you have made chargeable calls\data use etc).

If you want to keep your number then you need to get your PAC and use it within 30 days. Again you will get a final bill of £26.

BUT: If you request a PAC you MUST use it or your contract will continue and wont automatically cancel. As the difference is a few £ i would just phone them up now and get my PAC.
