    That's interesting seeing as N....r do NOT usually use a debt collector at all AFAIK. Complain to the BPA that this letter arrived and yet you have had no response except there was an unknown letter with unpaid postage which was never delivered (did you not collect it due to the unpaid postage)?

    OP said that in a reply on 13/11 I think ... PO wanted £1.20 but there was no identifying info on the envelope, and OP wasn't allowed to open it without first paying. So OP left it with the PO.

    Yes I did indeed have a "mystery" letter arrive in early November with underpaid postage and with this letter having no postmark or return address or P.O. box number and not being able to open it without paying the £1.20 the P.O. wanted I simply refused to accept it.
    I then asked "how will YOU know where to send it back" and they said that it goes to Belfast and then its opened up there..etc etc.
    I still have the P.O. card that was put through the door with reference numbers etc etc.
    Whether this has anything to do with N££££R or not then only they may now but I agree with Bazster that it can safely be deemed that no other correspondence was received by me from Tapier which maybe down to their incompetence and I'm certainly not going to pay theirs or anyone elses postage,so I will assume for now that they have gone "direct" until they wish to try and prove otherwise.
    My main concern is that although they seem to have sidestepped the usual route I still have to respond to this demand.
    And again I will agree with Bazster that Rapier should respond to my initial appeal(I thought it was within 35 days) with either a "sorry we didn't mean to bother you letter"...no chance of that I know or with the means to make an appeal to either POPLA or IAS, this was clearly stated that "this must not be withheld or delayed which would be a breach of the CoP.
    I'm going to write to both Rapier and the BPA and perhaps DRP as well though technically they shouldn't even be in the loop at this stage,I just want to be as direct and as concise as I can with all of them and I will of course make a point of them not replying to my initial appeal within a reasonable timescale.

    Yes, the COP requires them to either decide your "appeal" within 35 days or tell you why they can't and give you a date by which they will decide it.

  • So does that mean they can effectively leave these cases open ended so when the Beavis appeal case is heard in February they can then come back to have another bite( we all hope the appeal goes "our way") even though there has been no explanation within a reasonable time.
    Seems that they will still try to ride roughshod over us all as per usual and they are willing to stoop lower than a caterpillars blakeys!

    I haven't heard of that happening re the Beavis case. They have neither decided your "appeal" nor notified you of reasons not to with a revised date. So you can reasonably consider the matter closed and tell them so.

    Ive made no mention of the fact that I received an underpaid,unopened and completely unmarked letter with no return address which I left with the P.O.
    I have absolutely no idea who this was from and was only assuming that it may have been from said company.
    I had no reason to pay for the pleasure of opening a letter of this kind,though you never know...it may have been from one of those rich Nigerians offering me 25 mil...ah well

    Why on earth not? PPC world has no scruples about spreading doubt and confusion, can't see why you should feel constrained in doing the same.

  • thanks Bazster,I have now revised my original letter and I now agree with you that I shouldn't hold back and they will now have 14 days to reply or the matter is closed and not the 73 plus days inbetween correspondence.!
    Protest letter going to the BPA and one to DRP

    husheechee - having just finished with these scumbags, I can confirm that the letter you left at the post office is most likely to be from them. The same thing happened to me, and I paid to pick it up as I thought it might be something nice.

    It wasn't.

    So they probably did send it in time but it's typical of the way they work - they want to squeeze you for everything, including the postage THEY should have paid.
