Victoria Plumb order missed delivery

Hi, I ordered a bathroom suite (£1000+) last week from Victoria Plumb, and specifically chose delivery for Friday, the last day of the summer holidays. They gave me a time slot of 8-11am but it never showed up. I eventually got a phone call at 3pm saying that it had not arrived at the depot and so would not be coming that day.

They have rescheduled for Friday this week - however, this is a massive problem - both my wife and I are teachers and can't have time off to wait on for deliveries and the courier company say they cannot give us an evening or weekend slot. This is why we originally ordered it for the summer holidays, so we would be in.

I've read on here about "consequential losses" and it seems to apply in this case. Could I pay someone to sit at my house all day waiting for the delivery, then attempt to claim this back? If so, hoe much would be a reasonable amount to pay? £10 an hour? If I had the day off unpaid it would be £150+.

    Have you read MSE's article about failed deliveries?

    Go to the top of this thread and click on the blue text that says: Failed Delivery? Fight Back! 'If I waste a day, you'll pay'

    As they gave you a three hour slot last time, it is probably excessive to expect the seller to pay for someone to be there all day. I would suggest that three hours at the current minimum wage would be more appropriate. E.g. £20 approx.

    Make sure you clearly explain that to the seller beforehand.

    According to the website next day delivery can only not be performed on a Sunday, Monday or Bank Holiday, therefore by that logic they can deliver on a Saturday.

    Given the Schools are not open then I would insist they deliver on the next available Saturday to mitigate your loss and their cost.

    From their terms and conditions:

    We aim to deliver most products within 5 working days if possible; however some made to order items may take longer. Please note however that all delivery dates given are only and always provisional. Goods are subject to availability and delay in delivery of goods is sometimes outside of our control. All orders must be delivered within 28 days.

    I know it is easy to be wise after the event, but as school teachers, why on earth did you arrange delivery for the very last day of the holidays - you had six weeks?

    However, in the light of their terms, I think you will struggle to get any expenses out of them.

    What charge do they impose on the customer if the courier cant deliver at the agreed time, if no one is at home?

    You can bill them this amount citing unfair contract terms, if they refuse a weekend delivery

    From memory, most teachers take half the year off sick anyway. Just call in and book a sicky.

    Maybe it was only your teachers who had that problem simply because they couldn't take too much of you.

    Government stats show that 55% of teachers had AT LEAST one period of sickness absence last year.
