I am representing my granddaughter who is the registered keeper of a vehicle which was the subject of a PCN from Combined Parking Solutions, and am requesting help in the submission of the appeal letter to CPS. ( I was about to submit one based on the template letter when I noticed that CPS was the subject of an "exception" list on the Newbies thread which requests a picture of the sign on site).

I do have pictures on my ipad, but with my limited IT knowledge, I have been unable to transfer them to the new thread, so if anyone can help I would be grateful.(Unless the information below is adequate.)

Meanwhile, I have copied the text of the CPS sign which is as follows :

Combined Parking Solutions Notice Text (Note : Directly above the CPS notice is a separate sign saying : --

"TAXI WAITING ONLY" in text twice as big as the capitals in the CPS Notice.

"WARNING
Contractual Agreement
This private land is for the parking of motor vehicles when complying with the terms below:

CLEARLY DISPLAYED VALID CPS PERMITS ONLY

All vehicles must be parked in their allocated bay (if applicable) and not causing an obstruction.

The landowner and it's agents hereby permit all valid CPS permit holders who are clearly displaying their permits in the windscreen and parked in their allocated bays (if applicable) permission to park on this land in accordance with the terms of their permit.

The landowner and it's agents also offers all members of the public who have not obtained, have not parked in accordance with the terms of the permit or have not clearly displayed in the windscreen a valid CPS permit in advance, the right to park on this land at a cost of £100 per vehicle per 24hr period. (this will be reduced to £60 if full payment is received by CPS within 14days of issue).

A parking charge notice will be issued with instructions on how to pay this amount.
One charge per vehicle per 24hr period can be issued.

To cover additional administration costs the charge will increase by £50 per charge + court/collection costs if the charge remains unpaid and debt recovery or legal action has commenced to recover the unpaid charge.

Charges are in operation 24 hrs per day, 7 days per week.

Registered keeper details may be requested from DVLA if the charge remains unpaid after 28 days.

DO NOT PARK OR LEAVE YOUR VEHICLE HERE UNLESS YOU UNDERSTAND AND AGREE TO ALL THE ABOVE TERMS AND CONDITIONS."

The above text and punctuation is exactly as on the CPS sign, although size relativity and layout may be slightly different.

A bit of background :
The car park is a pub car park, there are no other businesses on site.
The vehicle was parked for approx.25/ 30mins.
There were no other cars parked during this period and no taxis came or left.
There are 2 identical CPS signs. The area in which the signs are located is approx. 5m by 6m. which could accommodate a maximum of 3/4 cars without blocking the route to the main pub car park. Within 3m. of the 2nd. sign is a barrier with a sign on it saying "PAY ON EXIT" (£1 charge) which is the main pub car park, and outside the jurisdiction of CPS. So the only bit controlled by CPS is the entrance to the pub car park.
This info. Is based on hindsight after a number of visits to the pub and discussions with bar staff. Any driver, visiting for the first time would be confused by the signage. My first reaction was to look for a dispenser/pay station where I could get a valid CPS permit!
I have some comments on the misleading aspects of theCPS sign :

1. The term "THIS private land" does not define any boundaries, and suggests the terms could be applied over the whole site.
2. There is no information on how to obtain a valid CPS permit. How can anyone comply with the terms? Do any exist?
3. Can the term £100 per vehicle per 24 hrs. be interpreted literally. For a 30 min. stay that would be just over 2 quid!

So far we have been unable to locate the landowner/landlord to make an appeal.
Also, the time limit on the appeal to CPS is getting close, so an early response and some encouragement would be appreciated.

    Difficult to give a detailed opinion without actually seeing the location (either by your images or street view) so the actual location would be useful.

    That aside, you should "appeal" upon which they will (or should) provide you with a reference number (to enable you to take it to POPLA) WHEN they reject your appeal.

    You can't post pictures because you are a newbie, but you can upload them to tinypic or photobucket then post a broken link, eg hXXp:/photobucketsignpic. One of the regulars can then convert it so we can all see it.

    Start by reading the Newvies Sticky and get ready to do a proper appeal as this will almost certainly be thrown back at you.

    Also be wary of any off-forum unsolicited advice being offered - There is someone who may well be a CPS stooge who often offers incompetent "advice" on these boards.

    They are looking for a test case of this ilk for this oik. Please email them at Parking Ticket Appeals Service <Appeals@parkingticketappeals.org.uk> and I am reliably informed that this case will be done for you free of charge. (By me, I'm reliably told...)

    In the meantime, please edit out anything that can allow you to be identified in terms of the parking event, ticket number or similar, because CPS are known to frequent this forum and others, and will be on the lookout for anyone asking for advice against them.

    Thanks TILT. Having seen the layout I agree.
    I am slightly confused in that I'm sure I've read on one of the threads something like "CPS don't do POPLA" or words to that effect? Can anyone clarify?

    - "If no time to 'dig out flaws' in paperwork, just use our appeal example UNLESS your PCN was from:
    'Devere' (Bournemouth usually, e.g. at Castlepoint)
    'District Enforcement' (Staffordshire University etc.)
    'Secure -a-Space'
    'Napier'
    'UKCPM'
    'Combined Parking Solutions' (astonishingly now pursuing families at Fantasy Island, Skegness, and normal POPLA appeals won't work)
    or
    'Premier Parking Solutions' (especially re a flipped ticket at Hull Docks where you must word your POPLA appeal very carefully)


    If so, please start a thread with a picture of the sign on site and don't respond to private messages offering 'help'. "

    Sounds like the OP has hit gold here for PTAS to be involved.
