I had the same situation, but on a different offer, on Wednesday, when the Dove Body Washes weren't showing 3 for £5 SEL - they scanned with that offer though. Just shows, again, how you can't ever assume the price on the SELs is correct:( - but then increases time, causing embarassment at the till/SS, if it turns out they are what the shelf says and no longer on the offer:(:(.
I don't know about the timings on these missing mbuys on SELs - maybe they were deciding to remove an offer, sent that message through in their daily price changes to the store(s), got them to take the mbuy SELs off, but then decided to keep the offer in the event. Wonder how this relates, if at all, to mbuys disappearing on a.com and then msm but then they decide the offer is continuing after all and we get those glitches.
I read [red] an 'interesting' (to me:D:rotfl:) article a few days ago, from a while back - and yes! I managed to remember some of the words used in the article and have just managed to find it again - it's here: http://www.groceryinsight.com/blog/2012/02/tes-go-big-price-flop-forget-the-cliches-what-are-the-real-issues-facing-tesco/ - relating to misprices, stockouts and POSs - and it also related to staffing shortages in T leading to promotional stock running out on the shelf, staff not able to get more onto the shelf, but instead it remains in the storage area at the back of the store, the offer ends, the store is left with a load of unshifted stock still stuck in the store.
You can read the full thing. A short section about "Price integrity" is relevant here and it says "...The legal issue aside (I’d estimate every single supermarket technically trades illegally as it’s virtually impossible to have every price right.) it does impact the store as refunds have to be given (double the difference)...".
In fact, I don't think it is technically trading illegally - as there is a thing called "due diligence" which is a defence to a prosecution and the store might be able to show it has been duly diligent. There may still be pricing errors, caused by human error, even if the store takes all reasonable precautions and has a proper system. As long as there's a proper system, the store may not be breaking the law - human errors can still occur, even in the best system, and the law doesn't mean that you have to have every price right.
The case of Tesco Supermarkets Ltd vs Nattrass [1972] AC 153 deals with due diligence, although it relates to the position under old law. It does show how prosecutions for alleged misleading pricing can fail and I believe probably discourages trading standards departments, especially in times of financial pressure, from taking on prosecutions that they might lose and cost the public purse dear.
There are also issues as regards individual employees, on the shop floor, not being part of the 'directing mind' of the company and this creates further difficulties - there was also a case, from memory, that revolved around the meaning of the words "of his" in the (now old) Consumer Protection Act 1987. Since the employee was involved, the pricing wasn't the business "of his", namely the company prosecuted. (Or maybe I have not recalled that quite correctly.) Those minor two words - "of his" - were vitally important! The current law is contained in the Consumer Protection from Unfair Trading Regulations 2008. Regulation 17(1) states:
"In any proceedings against a person for an offence under regulation 9, 10, 11 or 12 it is a defence for that person to prove—
(a)that the commission of the offence was due to—
(i)a mistake;
(ii)reliance on information supplied to him by another person;
(iii)the act or default of another person;
(iv)an accident; or
(v)another cause beyond his control; and
(b)that he took all reasonable precautions and exercised all due diligence to avoid the commission of such an offence by himself or any person under his control."
We're talking here, of course, about pricing that suggests it is lower than is in fact the case, rather than cases of missing mbuys where the price on the shelf is in fact higher than the price you pay!
Pricing can simply be due to "a mistake" - it wasn't changed when it should have been but, if there are proper systems in place, the reasonable precautions and due diligence can again apply. This may give a certain leeway to stores where the price has gone up but the SELs don't get changed immediately to reflect that - there is a certain amount of time and reasonableness here and it may still be taking of "reasonable" precautions even if the SEL is not changed immediately but is 'about to be changed' in the course of normal systems. So they don't necessarily have to be out on the stroke of one minute past midnight to change a SEL, to change every SEL, where price change day has just started. So it isn't the case that "every single supermarket is technically trading illegally", instead no supermarket is trading illegally in this sense as not every single price can be got right, human errors will always occur even in the best system and only mere "reasonable" precautions are required, not every single possible precaution.0 -
