Stale mate - seller refuses to complete and move on the same day

I never exchange and complete on the same day, done once went badly wrong. This is the issue it is stressful when it works when it goes wrong it goes wrong spectacularly.
I insist on at least a two week to a month gap this allows for removals etc to be booked with the knowledge that if things do go wrong you can sue the responsible party.
I also won't complete on a Friday despite Solicitors love of this day. If something goes wrong with the payments Saturday is not a clearing day and a lot of solicitors don't work on a Saturday. It is a nightmare of stress and anxiety.
In the OP's case I would want a gap as the vendors sound unreliable. Once exchange has happened and the completion date is fixed if she doesn't move out there are steps that can be taken. Given that she is being flaky Monday as a completion date sounds the best.
Do not let her stay in the property once completion has taken place, change the locks straight away (something I always do).0 -
I work in a solicitors and we certainly have no preference for a Friday, in fact we would prefer it to be any other day just in case there is a problem with monies not arriving on time, we tend to find that clients want a Friday so they have the weekend to unpack0

Lots may do, but having been one of those people it went wrong for I would never do it again.
Apart from the issues I had you have gazumping, gazundering and the option of a flaky vendor changing their mind at the last minute. All of this can be avoided by having a gap between exchange and completion.
Divorce sales tend to be more complicated as there is more than one vendor and they can be antagonistic to one another, then add the stress of selling a house and it is an explosive mix.
As for having read the Op's original post phil99, yes I have. Not sure what the point you were trying to make was as you didn't elaborate. Not jumping on the bandwagon I have given reasons why I think it is a bad idea, the forum is for people to give advice and opinions.
If I was was in the OP's position there is no way I would agree to exchange and completion on the same day. I can see no valid benefit for them but a whole lot of reasons not to do it.0 -
