CM Services Ltd - Parking Fine

Hi,

Yesterday I received a parking ticket for £100 for parking on a private car park.

I know I shouldn't really have parked on there but I thought the parking was for a shop which is currently empty (up for let) and so wouldn't have been monitored.

It turns out I was actually parked on another businesses car park which is why I got the ticket. But again, the business is closed on a Sunday and not trading.

The car park is a shared car park between 4 shops and its not very clear as to which spaces are allocated to which shops. There is also 2 contradicting signs - an old (unofficial) one which can be seen as you drive into the car park which states that cars will be clamped with a release fee of £50 (which is now illegal) and then another inside the car park by CM services ltd stating the contract and consequence, which can't be seen when entering the car park but is visible once in (both signs are on behalf of the car park spaces for which I got the ticket).

I have read a few posts on here and think I may have a case not to pay due to an unfair amount as the shop did not loose £60 through loss of earnings as it doesn't trade on a Sunday and also perhaps the contradicting signage?

Can you advise on what I should do - either just pay it because I don't have a case or fight it?

    If you go to the newbies thread and read it you will realise that of course you have a case against scam tickets and you really should fight these bullies.

    Thanks, I'll give it a proper read when I have a bit more time.

    I suspect the person who issued the ticket may have pictures of me driving the vehicle as I saw a person with a camera taking pictures from a safe distance (as to not make me suspicious). Its only after I returned to the car did I realise what he was taking pictures of.

    I therefore don't think I can go down the driver responsibility route.

    Do I still send off my appeal once the NTK comes through stating unfair amount and signage - or does it not matter that there was a clamping sign up as well?

    In the unlikely event they do have pictures of you (rather than just your vehicle), so what? They don't have a database of mugshots of everyone in the country that they can use to identify you from a photo, and nor can they make you attend an identity parade!

    Yep same as all the other cases on here, pretty much. Meanwhile, search the forum for 'CM Services' or try 'CMS' as a keyword and read other threads from 2014 only. :)

    But remember CM Services are members of the IPC not POPLA. So you will only have 21 days to appeal at each stage.

    This will actually affect the way you appeal. Photos of the signage will be useful if you can get them. That old clamping photo particularly will be of great use. But also photos of the other signs will be good. If the old clamping sign is still up, there is a good chance the other signs are old which might mean we can claim no GPEOL

    Also we have several times found that their NTKs are not always compliant with the law.

    So we would want to see these redacted as well.

    If you look for the IAS Success stories thread (in first couple of pages hopefully) click on the links through to successful appeals to see what we have advised for the second appeal.

    As this is an IPC company, no GPEOL does not win the argument to the way it does with POPLA. Only if the signs are old ones.

    So my advice is not to word the appeal using the template, but to write your own version. But with our help when the NTK arrives.

    Just to confirm we are assuming that when you say you got a PCN, that it was a windscreen ticket you are talking about, not one that arrived through the post? If it arrived in post the it is the NTK!

    Yes, the PCN was a windscreen ticket (on which they spelt Mercedes wrong).

    I'm pretty sure their official signs are up to date as I read on here they previously had the wrong members association on - but now have IPC on. I have pictures of both the old clamping sing and the official sign.

    I will send you pictures on the signs and also the PCN privately.

    I would post the pictures of the signs up on here and also consider a redacted copy of the PCN.

    Reason? IPC PPCs are not easily beaten on contract/GPEOL but it appears that they get their signs screwed and also their NtKs are non compliant.

    If you let the forum gurus see the evidence, then may heads are better than one and, selfishly, we can help hone our collective experience on dealing with IPC PPCs.

    Absolutely the more people getting their heads around the mistakes in wording on NTKs and signs the better.

    We are all slowly getting up to speed with IPC appeals, lead in the main by Coupon-Mad, but we are starting to get the gist of the needs for such an appeal.
