Another victim of Parking Eye at Leisureworld. And I'm very angry!
Thought there was 4 hours free. Parked for 2.5 Hours on Sunday 10th from 16.00 thinking free until 18.00 when charges end.
Received PCN on 25th wanting £100 and second letter on 29th saying discount if paid on 29th. Ridiculous.
I've complained bitterly to Odeon Manager by email and was told in reply they have 'no control' over Parking Scheme. I've replied asking for their CEO details, the Landlord details and queried whether they would reimburse me any charge as a gesture of goodwill for not taking reasonable steps to inform customers of scheme - requires entry of details into a machine somewhere. I'm definitely not letting them off the hook and also mentioned the Press and Social Media.
Thanks to all the amazing Newbie advice on here. I want to praise both Deniswise9 and BenefitMaster whose contributions in a recent thread on Leisureworld (tried to post link but as newbie I'm barred) helped me tremendously:-
I have three requests / questions:-
1. Can I use Denniswise9 letter in any POPLA appeal - don't want to plagiarise or make POPLA play 'hardball' if they see a replica appeal statement?
2. Is Leisureworld part of Southampton Port and therefore included in 'not relevant' land?
3. Odeon suggest I send proof of attending cinema to Parking Eye to get them to waive fee. Looking at threads on here I doubt they will waive even with proof - what do you think? I don't want to jeopardise in any way my Registered Keeper status which, if my understanding is correct, gives the best chance of success under the 'not relevant' land point. Hope that makes sense?

Don't worry about popla right now as you are not at that stage , put the appeal into parking eye with proof that you were a customer on site, then wait for the answer off them. And continue your complaint to the Odeon , you are their customer they shouldn't be wiping their hands of this!When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Presumably you could then hold the people who made the contract with PE jointly liable? Yes - thanks. Seen the posts from BenefitMaster about potential fraud. Am storing up the info. at present for appeal stage if needed. Has anyone else reported to Police?0

I have no idea. I think the problem is that people are often afraid to, either because they don't like getting involved with police. Or because once they have found this forum, they know they can get it cancelled and don't want the extra bother.
This I can understand. It is much easier to want to let someone else take up the fight. (I'm not being critical of anyone here, I think it is just human nature).
I think on the forum, we live in hope that if enough people complain to police that eventually they will feel they have to do something. So whilst they might not act on your complaint, 20 complaints later, of which you were one, they may feel they need to do something. As ParkingEye are the most aggressive PPC in terms of litigation (they issued tens of thousands of court papers to ordinary law-abiding people in a year - not joking!) they deserve everything coming to them. Complaints to the Police about PE, for saying in the Notices that a keeper is liable on land where they know a keeper is not liable is a very, very good way to fight back against this pariah/parasite firm.
So many threads about this - if you all report them to the Police and the local Trading Standards (Southampton area) and insist this has the appearance of a crime, due to the misleading document and the fact that Benefit Master can prove PE and the landowner Associated British Ports certainly already know this isn't relevant land, it would be more likely to be investigated. You will all win at POPLA but that's NOT the point. Most ordinary 'non-forum savvy' or vulnerable, dim, busy or elderly people don't have a clue how to win at POPLA or even what it is. They actually believe they have been sent a parking ticket and are liable whether they were driving or not (even if they were driving, these fake PCNs are fully winnable on appeal - and if they ignore one PE sue people and often win in court as they pay a law firm to get trophy victories at a loss). It is shocking. Loads of victims cough up the money, and all will be registered keepers because that's how PE work (they don't apply a windscreen ticket so the keeper is WRONGLY targeted every time).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

If you do complain to the police, complain in writing. But also complain to your local trading Standards Department who may need just one more complaint, (yours), before taking legal action.You never know how far you can go until you go too far.0

I've entered Appeal on Parking Eye site. Used variation of template letter and referred to the POFA12 point as first point as well as the others. Included proof of cinema attendance.
Also had email from Odeon - the Manager this time. He tells me Customers should not have to pay. Nice to know. He tells me sending proof will be sufficient and if I have any problems I can contact him personally. I'll take him up on his offer I expect. I replied and said I'd appealed to Parking Eye. I invited him to think whether Odeon should be associated with a Parking company such as Parking Eye. He referred to the charge notice twice as a 'Fine'. I've replied advising him these are not fines and Odeon should consider, perhaps with support from Trading Standards, whether they wish to be associated with a profiteering racket like Parking Eye - particularly as, unlike me, a lot of their customers may feel intimidated or harressed by Parking Eye. The manager did say he has asked Parking Eye to 'review their communications'. Odd that, given their initial reply that the new parking system is 'out of their control'0
