    You are at post 4 stage of the newbie thread. Read it again.

    You can try an appeal as registered keeper but unlikely to work or you can continue to ignore and prepare for when you get an LBCC. But remember these are often won!

    Same advice as all the other PE cases getting DRP letters, we get this every other day. Search the forum for 'ParkingEye Recovery Plus' (ParkingEye being one word!) to read the umpteen zillion other threads asking exactly the same every day. The only problem is, yours is PE and they sue people so obviously submit an appeal online - NOT saying who was driving. So it's like all the other DRP cases where the PPC is ParkingEye, like here for one (just one thread of HUNDREDS all the same from people who haven't bothered to appeal and have sleepwalked towards a risk of PE suing them in the end):

    I’ve had success with my appeal against the PCN I got from ParkingEye at the Crown Wharf Shopping Park in Walsall.

    Essentially I was sent a PCN through the post which I foolishly ignored until it got to the Debt Collector stage.

    I thought I’d read the Newbie post in detail when I posted originally but, upon advice, I went back and read it again in much more detail. Following this I sent off a barrage of physical letters (as opposed to emails).

    I sent a version of the letter suggested in Post 1 of the Newbie thread to PE. Here’s the link to the thread:

    I had eaten in a well-known American/Italian restaurant, so I sent a letter to the Manager of the restaurant I’d eaten in. They are part of a bigger group, so I also wrote a different letter to their CEO, whose details I found from their web site/LinkedIn/Google etc.

    The shopping park is managed by a Property Management Company so I phoned them, found out the name of the Director who was responsible for the property and also wrote him a letter.

    I also wrote direct to the Manager of the Shopping Park at Walsall complaining and also offering to pay the £2 I should have paid if only I’d seen the signs.

    Finally I found details of the Investment Institution/Unit Trust who actually own the land and wrote to them.

    The letters to PE and DRP were the suggested letters, not deviating into mitigation etc. However, the letters I sent to everyone else did contain mitigation (Both me and my colleague (my MD) were not from the area, couldn’t remember which one of us was actually driving and both of us genuinely never saw the signs) and also very strong complaint, including questions about the loss they thought they may have incurred by the car being parked there without payment.

    A few days ago I got a letter from PE saying that the PCN had been cancelled, which was great.

    At first I was not sure which approach was the successful one. I did get a letter back from the restaurant saying that they had no control over this, so couldn’t do anything. I am not sure if it was in response to the one I sent to the CEO or the Manager or both, but either way they were next to useless.

    I have, however, now got a letter from the ultimate land owner saying that, as a gesture of goodwill, they have spoken to Parking Eye (sic) and had the PCN cancelled.

    Interestingly, though, in their letter they say that they are required by Walsall Council to enforce parking restrictions which are equitable with other car parks in the area, which is something I’ve not seen before. They also say in their letter that there are numerous signs and payment points in the car park and can’t understand how we never saw these, which is fair enough. The restaurant chain have sent me a photo of the car park which does have loads of the yellow signs on it. So, I don’t know why me and my boss never saw them, but we just didn’t.

    Also, interestingly, I have received two more letters from DRP making more threats and I’m seriously considering writing to the CSA to lodge a complaint against them, because I had instructed them to “cease and desist”.

    So, my advice to anyone in similar situation is to not panic, don’t ignore the letters, really read the newbie thread in detail, follow the advice contained in it and write the suggested letters to the PPC and Debt Co. Also do a load of research into who owns and/or mangers the land and write strong letters to them. Write to the companies you spent money with whilst parked as well, but don’t hold out that much hope in getting results from them. Really focus on the land owner.

    I hope this helps other people who may have found themselves in the same position as I did.

    You can complain to the BPA (email in the Newbies sticky thread, post #6) that PE haven't called their dogs off.
