Mis-Sold EE Contract?

Long very irritating story. Despite previous awful EE customer service I went in today to sort out an upgrade to a new phone, my contract runs out 2nd sept. Having heard not a peep from EE about an upgrade or even confirmation of my imminent ending I went into the shop to discuss options. I knew what deal I wanted and what phone etc. I spoke to a man who told me to upgrade today there would be a £50 charge (I only pay £27 a month as it is!) and would therefore be cheaper to take out a new contract, which would be less hassle too as current contract is in my moms name. Took out new contract under the assumption I was saving myself the £50 charge, and that I had no upgrade deals as I wasn't offered any! Rung EE later on in the evening to ask about how to swap my number over (old contract was on Tmobile) only to be told that the £50 was a lie, I could've upgraded FREE OF CHARGE from August 5th and I would've only paid £200 upfront for phone instead of £300! Helpful lady on phone told me she has reported the store for misselling, has put a note on my contract that I have a right to cancel and that I need to go into store tomorrow and cancel the contract with them, and ring up to upgrade.

A few questions remain: How likely is it that the store will even care enough to cancel/refund the £100? Also if I upgrade rather than take out the new contract, would I be able to transfer my number easier as at the moment I need to transfer it to another network and then back to EE, as the PAC code for Tmobile and EE is the same? Plus, if they refuse to cancel the contract then I won't be classed as upgrading so would they waive the cancellation charge, not that I even see how there could be one for the remaining 3 days..

    Hopefully you have managed to get this sorted today. EE should give you a full refund in line with their returns policy. You don't need a PAC code to upgrade from T-Mobile to EE. They will simply send you a new EE sim card and you'll be good to go.
