This is a standard Debt Recovery Plus letter, not bailiffs - and they can do zilch in terms of taking this to court. Only the landowner, or PE can.

So your father can ignore DRP, but he can't ignore PE as they take around 10% of ignorers to court. At the moment he's not there yet, but well past the point of him making a winnable appeal via POPLA.

But, if you were the driver, he can respond to PE and give your name and address for service as the driver on the day. This will reset the clock and PE will have to pursue you, then you work from the NEWBIES sticky with an initial appeal, then further forum help with a POPLA appeal.

Your father must do this urgently and before PE commence court proceedings - which they are quite likely to do. Time is now of the essence.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Yes but HE needs to send your name and address, NOT YOU. As Umkomaas rightly said. Then you sit and wait for the PCN that you can appeal as per the advice in the top thread.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
