VCS parking notice?

Umkomaas,
The second quote you put in i had written myself, the sign on the entrance is in fact on a hill into the car park of a rather busy A road there is very little time to read the sign unless you want to stop and cause and accident from behind. by this point you have already entered the car park.
i have already edited the first quote as there is no free parking after 7pm for less than 2 hours, there is no free parking time period only the initial 10 minutes.
again im sorry for posting straight away i wanted to make sure it was the correct one redx was talking about before i started editing. im combing through now trying to make sense of this all.
i can understand why people just pay these things to get rid of them, especially when your not very clued up on all of this kind of thing:j0 -
OK, thanks for confirmation.
If the paragraphs I've highlighted are factually correct then you're definitely on the right lines. Just pick through it again to ensure their are no 'slip ups' and I think you can soon be on your way with it.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

agree with the comments
you do the work, people here will skim read it, but as volunteers working for "free" we wont be spending the time for the "due diligence", especially when so many people need helping
I am sure you are close to the "end game" , whereas those too lazy or busy to do the work can pay parkingticketappeals.org £16 to do the work for them
all I was asking was that you adapted that appeal in notepad FIRST, then posted it for critique , having removed the words CIVIL ENFORCEMENT and CEL etc first , otherwise people being pedantic (like me , lol) will pounce on it and not bother skim reading it due to all the errors like I saw earlier
ie:- when you post one on here, it should be your version of the appeal, not a copy/paste , as a copy/paste wasnt required as I linked you to the actual appeal to derive yours from
hope that explains it ? in which case, keep at it0 -
slightly unclear on section 3 and if it applies to me as i have already contacted VCS and pretty much said i was driving should i include this section for POPLA or will it be used against me due to my contact with VCS?:j0
-
agreed, a shame really as otherwise it would be kept in and make their job a lot harder
too many people readily admit they were driving when they dont need to, a rookie mistake I know, but a no comment interview is better than , yes guv, I did it, sue me , lol
so POFA 212 is irrelevant if they pursue a driver because the driver admitted driving
not the end of the worls, but a shame nevertheless0 -
You seem to have used a CEL template instead of adapting one of the VCS examples that you see when you click on 'How to win at POPLA' in post #3 of the top thread.
In your latest draft the whole of point #3 is about only CEL Notice to Keeper letters, not VCS cases. VCS don't 'only have wording on the payment slip' so this looks wrong and VCS will point it out. Nor do their NTK letters miss out all that wording from the POFA, which you could have checked fairly easily as I link the Act in the top thread and the requirements for a NTK are spelt out in simple bullet points. A quick 'spot the difference' exercise comparing your NTK with the paragraph 9 section in the Act would show you that VCS NTK letters do not omit all that wording. But you didn't even need to start doing that as a recent VCS appeal is just waiting for you to adapt it, this is like pulling teeth trying to help you to use the one that's most suitable.
I think it's going to be '3rd time lucky' in terms of your drafts. Take one about VCS from post #3 of the newbies thread which you were advised to do, all along.I also know someone else with the exact same situation he appealed to VCS and they replied with as a good will gesture they would drop the charge but still charge £10 admin fee.PRIVATE 'PCN'? i was using the VCS template then was told to use the CEL template...
as for point 3 i had already taken that out. But ill just go back to what i was looking at in the first place and adapt it.
thanks
as for the guy being charge £10 he refused that and they have written back charging him full price again as he refused to play the £10 also.:j0 -

not true at all
I didnt tell you to use either appeal (they are previous appeals, not templates)
I definitely said (in your words - "told you") to adapt the VCS no ticket appeal linked by CM in her appeals thread, which I also told another member in their thread about VCS and gym membership too, that was an end of the guidance from me at that point
then you posted a post I did not understand but seemed a bit strange so I suggested (not told) that you look at the gym thread for CEL and maybe adapt it or use stuff from it instead
but my mind was always made up that you should ideally be adapting the VCS one and change it into a VCS appeal that reflected your circumstances and not theirs
they are NOT templates, that is where most people get it wrong as they blindly copy and paste them as you did earlier, as if they actually are templates when it clearly states they are examples
they are actually examples of appeals that were approved at the time they were written but are tailored to meet the needs of the OP in the thread they are in , which is great if they are JLA or RHA or Birmingham or Luton airports , or Southampton Docks (ABP) os other sites that feature daily on here like Peel Centre in Stockport , where they eventually become "templates" for those sites and are easily adapted for similar sites
the appeal letter in post #1 of the Newbies thread is definitely a template letter to any PPC - of that there is no question
but the ones linked by post #3 of that thread are actual appeals and generally NOT templates , they are EXAMPLES of popla appeals - there is a vast difference , so for popla or IAS appeals, or court defences, there are NO templates, as each is an individual case and has to be treated as such unless its a site like JLA where its 99% written for members nowadays due to its frequency and the narrow band of issues they send out about it (usually stopping where you should not stop)
here is the actual wording of post #3 , for clarityClick on these words: How to win at POPLA and you will see clear adaptable examples of winning POPLA appeals, some specific to the main PPCs and others specific to Airports, Railway car parks, retail, etc.
there is no doubt in my mind that the VCS example is the best one to adapt, which is why I mentioned it in this thread and the other gym thread for VCS, it remains so too
I gave the second example so you could see what they had written about a gym for a CEL appeal and get the idea of how yours could be formatted and adapted to suit , perhaps plagiarising both
to be clear on this, I searched but didnt find a suitable gym appeal at all, so I gave you the best 2 options and you then make up your own appeal, posting it on here for critique when finished
hopefully we would then have a superb example of a VCS gym appeal that could be added to all those links for popla appeals, by CM, in her post that lists them all
good luck
ps:- if the other guy uses the template appeal from here (post #1) and gets a popla code, then uses your final popla appeal draft , he will pay nothing at all, like you, meaning they havent charged him anything at all !
"its not over until the fat lady sings" and until then he doesnt pay a penny, neither do you too0 -
sorry red, i was getting mixed up, my fault.
ill leave it there, im causing to much grief here
thanks for the help.:j0 -
all we want you to do is draft your VCS popla appeal and then post it on here after you have checked it, so people can skim read it looking for errors or additions or corrections, but its a lot of work for people who do it for free so we expect you to have done as much work as possible prior to posting it
the examples are there to help you formulate your own appeal, if there were NONE you would have to start from scratch which would be a lot harder to do
the point about the VCS appeal we mentioned is that its already about VCS, so as its not about airports it doesnt have those issues in it, meaning that maybe 80% of the appeal is done for you, no changing the PPC names etc, then you tailor it to suit your case
maybe even collaborate on an appeal with that other member with VCS gym issues - get creative and pro-active , but we wont do it all for you
should you wish it all done for you , you pay parkingticketappeals.org £16 and they will do it all for you
so its pay them , or D I Y , with guidance from previous appeals on here (not templates)
good luck0
