VCS parking notice?

Hi,

Recently there have been some changes on my gym car park and VCS (vehicle control services ltd) have issued me 2 parking notices for £60 and will go up to £100 each if I do not pay with so many days.

The car park is for gym members only and I am a gym ember but I didn't enter my car reg upon arrival the first few times as I did not know I had to do this, they state the staff at the gym proactively told all members about the changes but I did not hear anything or receive emails. The only time I heard anything was from other members receiving charges.

I have unfortunately replied to them with the times of entry from the gyms database showing that i was in fact using the gym when I used the car park but they still say I have breached the terms and conditions in regards to not entering my car reg on arrival every time.

I also know someone else with the exact same situation he appealed to VCS and they replied with as a good will gesture they would drop the charge but still charge £10 admin fee. I don't understand why they have picked and chosen who to drop charges for and others not under the same situation.

Wondering what to do from here I have moved address so I don't know whether they will get my new address from Dvla or what. Should I just ignore it from here on out. I am also worried about my credit score and thing I don't want anything affecting that
I have worked on for a while as I will be looking to buy a house within the next 12 months.

    Start by reading the Sticky thread for NEWBIES at the top of the page. This has all the information you need on how to beat these PCNs and pay nothing at all. In fact, you will cost the PPC money


    If you have not yet received the NTKs then do not contact the PPC until you do.
    Meanwhile complain long and loud to the gym and TELL them to cancel these fake unenforceable speculative invoices.


    Do not ignore. It's a shame you have already contacted them because you have effectively outed yourself as driver. That's a bad move.


    Have you informed the DVLA of your change of address. That is very important.

    They rejected your appeal, have they provided you with a popla code for each ticket on rejection ?
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Good point. If you haven't received a POPLA code then complaints to the BPA are in order.

    Yes Stroma they have given me 2 POPLA codes.

    I have mentioned it to the gym and they say they can't do anything there hands are tied. They even told me to just ignore it they are a private company they can't do anything. And that's from the gym.

    I have sent things off for changing my address on my license and car registry.

    There will be no update from the DVLA to VCS of your change of address, so you need to make sure that any mail going to your old address is forwarded, redirected or collected. You could inform VCS when you appeal of your new address, but there's no guarantee they will make any note of this.

    You won't have your credit rating affected - you are totally in control of this, not VCS, not a debt collector, not even a court. I often put up this list so you can read for yourself how this works. Here goes:
    1. You go to court
    2. You lose your case
    3. The Judge awards costs against you
    4. You have 28 days to pay up
    5. You fail/forget/refuse to pay the costs awarded against you
    6. You receive CCJ
    7. Credit rating qualified
    8. Potential problems getting credit in future.

    A few long steps before the hangman pulls the lever. But all within your own control.

    But you won't be going anywhere near a court with this. Just read the NEWBIES sticky and follow advice there. This can be very easily beaten at POPLA.

    You are time constrained with sending a POPLA appeal. How long ago did you get them? If you are still in time you need to use one of the winning appeals best suited to your situation from the NEWBIES thread, How To Win At POPLA.




    ... and in my humble opinion, the Gym are lieing if they have contracted VCS to mis-manage the car park. The Gym are the Principle and VCS are their agents, therefore the Gym CAN get this cancelled. Go back and complain again, but longer and louder this time.

    Read the newbies thread, the part about popla is what you need. Appeal each one with exactly the same wording , just post it up before sending.

    And put a complaint into the gym, saying their hands are tied is crap, they are the principle, vcs the agents! Of course they can do something, tell them you are cancelling your membership because of vcs, get some others at the gym to do the same, they will do something then!

    They say they want the payment by 3rd sept .if not it will go up to £200 (£100 for each). Should I send this through to POPLA just as an extra measure?

    Ignore the 'discount' bribe as you'll be paying nothing IF you follow advice here.

    This is your ONLY option to be certain this goes away. Fail to appeal to POPLA (and by their deadline) will leave you exposed for up to 6 (yes six) years to a small court claim against you from VCS. And the more tickets you have, the more 'attractive' you are for them to pursue.

    Just as an addendum to my prior post. As you've already appealed to VCS there will be no further reason to contact them, so pointless giving them your change of address detail.
