buymobiles.net no xperia z2 sent. Any advice?

Hi all,
This is my first post hopefully somebody can offer me some advice?
I ordered a sony xperia z with a 2 year contract with 3 through a company called buymobiles.net. The package arrived through parcel force 24 and signed for by my partner. I arrived home opened the parcel to find no phone in the box just the sony box with all accessories but no phone and no seal.
I contacted the buymobile.net they told me to contact police and get crime ref number, the police wanted nothing to do with it and cant help, they also want a copy of my signature ie my passport, but i didnt sign for parcel so whats the point.
Is this a scam? Anybody else have a similar problem? I am worried that i will be paying £35 a month for nothing! I have to pay not to my adversely effect credit rating.
