Parking Ticket Advice Please

Hi,

We recently stayed at a hotel where there was 2 hours free parking before the car had to be moved.
On checkout the car was bought from another nearby long stay car park and parked at the hotel.
The car was parked in one of the nearest spaces to the entrance due to the weight of the luggage and it being a very windy day.
After 5 minutes of luggage collecting the car was given a ticket.
The car was accidentally parked in a disabled space which wasn't realised at the time of parking hence the ticket.
The hotel was contacted and advised of the honest mistake and the circumstances surrounding it and the fact it was only for 5 minutes whilst collecting luggage, but the hotel advised they could do nothing as they don't own the land and it is a private company that does the car park.
The parking company is UKPC ltd. The ticket states 14 days to pay or the fine goes up.

I have read the sticky above and would greatly appreciate any advise provided as to the next steps.

Does the fact it was a disabled space make any difference to the advise given?

There were many empty spaces around, some disabled, some reserved for flats.

doesnt matter a jot, its private land so doesnt matter if its empty or full

just appeal it on legal grounds as shown in the NEWBIES sticky thread

"what happened" on the day is rarely of any relevance

You are saying the car park for the hotel is not owned by the hotel? And they have no control over it . And there is only 2 hours parking?

This is not a hotel I would want to be staying at. Bad review on tripmadvisor is my first thought.

Yes appeal and get it squashed, but I would be putting in some serious complaints to hotel manager/owner/CEO or whomever!

  • Thanks for the replies.

When you say appeal, do you mean through the parking companies appeal process?

Have you received your NTK yet through the post?
Presumably this was your car that received the ticket, not a hire car.
When you get your NTK you appeal to UKPC using template in newbie thread. Or write your own. It doesn't matter.

Your aim is to get a POPLA code or a cancellation. The POPLA code will be used for the second appeal which will win!

Yes you have to do that before you can appeal to POPLA. Hence why I wrote a template appeal to suit all cases - the one in the newbies thread - for use ONLY when you get the first letter (explained in the thread).

  • Hi Again,

I have now received a NTK letter. Before I use the template in the newbies section to appeal it, I just want to know, should I edit the template, or just send it via the online system as it is?
Point B (The signage on site is deficient and fails to comply with the British Parking Association's Code of Practice, Annexe B.) and point D (Your notice was deficient and fails to comply with Schedule 4, Protection of Freedoms Act.) do seem to be covered in the NTK letter, as far as I can tell.

Should I then edit these out leaving only points A and C in the appeal template?

    Any Advise here greatly appreciated

use ALL of the points in the appeal, its not about what you think, its about disputing their case , which they brought about in sending you the pcn or NTK

its "prove what you state", all of it

so you allege its all false and tell them to cancel it or prove it all at popla later , hence using ALL of the template letter
  • Ok, thanks for your reply,,

How come we have 3 posters asking that in a few days?

Why are posters trying to prune perfectly sound appeal points off the template that's clearly written as a 'one size fits all' challenge? I don't understand why you and those others, would want to be editing the template appeal to remove points? Frustrating that (despite the words 'SUITS ALL CASES' right above it!) I am clearly not getting the message across in the Newbies thread then, if people can't see they just.need.to.use.the.template.
