Hi

Just a bit of advice (and reassurance) needed if possible please.

My husband has received a PCN from Parking Eye for not buying a ticket at Fistral beach.

We, stupidly I know now, sat in the car park and ate our fish and chips whilst watching the waves. We stayed for according to the letter 51 minutes, this should have cost £2.50. We didn't get a ticket as we didn't leave the vehicle and to be honest were concentrating on eating our food :/

I have spent the day reading threads here and the links given and now all the info is a jumbled mess in my brain and my head hurts, lol.

So, do I literally copy and paste ALL of this? onto their website?

I refer to the above notice which I appeal against, as keeper of the car, on the following grounds:

a). The sum sought does not represent a genuine pre-estimate of yours or your principal's loss.
b). The signage on site is deficient and fails to comply with the British Parking Association's Code of Practice, Annexe B.
c). In the absence of any evidence it is my case that you lack any or sufficient proprietary interest in the land.
d). Your notice was deficient and fails to comply with Schedule 4, Protection of Freedoms Act.

Please uphold this appeal or send a rejection letter so I can escalate this matter to the independent service offered by your Trade Body.

    the NEWBIES sticky thread does tell you everything you need to know though

    ps:- your vehicle was stationary , which is PARKING

    you were zapped by the ANPR cameras, in and out

    Sorry to seem such a thicko, what I meant was do I use all a,b,c,d points or just use a as that seems most appropriate?

    Will definitely be reading the boards in all car parks I go in from now on though

    They are all appropriate points of challenge to raise in all cases which is why they are on that short template. You should have seen the long version I used to suggest a couple of weeks ago - that's nothing!

    You had the same query as this person did, trying to pick out part of the template letter when in fact it's a one size fits all example:

    As others have said, just follow the tried & tested templates and it's at POPLA stage where you will need to adapt an example to suit. When you get a POPLA code you can find the templates for POPLA in post #3 of the Newbies thread. Now they are long!
