    they are also rejecting any counter claims by you

    Alright thanks a lot :) so the other letter is essentially them telling me they are refusing any claims I try and make against them? Surely on that logic I can just say I am refusing any claims from them also?

    you could try that but POFA 2012 makes the RK liable in law, unless they name the driver, in which case the MCOL rules apply (another law)

    do you not think that out of the millions of tickets issued that people havent tried the obvious get out of jail free card options yet ?

    if they try an MCOL, by all means take out an MCOL counter claim like Benefit master has done with PE

    also bear in mind you could end up in the high court like Mr Beavis

    I think il just submit a POPLA appeal, that seems like the safest option? I don't fancy going to court

    Just do the above - PE signs are always too high up on poles so don't over-think whether everything is appropriate. And anyway the case won't hinge on the signs - PE will give up as soon as they see a version from our example POPLA appeals talking about no GPEOL and the Beavis case/ Chris Adamson's words about no commercial justification.

    It's easy - just read back several pages from the latest entry on the 'POPLA Decisions' thread and tell us what pattern you spot in all the PE outcomes...every time for months.

    Okay so just read through the POPLA appeals section in the newbie bit? The ones for parking eye? I read through a template what to send but I saw that you said it was a little old and it also used different court cases to what parking eye send out on their rejections now. I don't wanna send something over that is wrong or in accurate and have it rejected haha! Worried as I only get one chance at a POPLA appeal

    You haven't found the 'POPLA decisions' thread yet and read the final ten pages or more, have you?! It's a sticky thread in Crabman's forum stickies near the top. DO NOT read from the beginning as the first pages are old. Start at the end and work your way back and see the pattern of PE cases, every time.

    And yes of course you use the sticky thread post #3 links to PE examples of a POPLA appeal (either a free car park one or a P&D machine one to suit yours). The info mentioned about Beavis & commercial justification is not 'old' and I know for a fact PE include 'Beavis & Wardley' in their stupid letter.

    Ahh okay yes I read the sticky post #3 on pay and display machines! I thought it mentioned a different court case, must be my mistake haha :) no I haven't read the last ten pages or so of appeals I will have to find that and read through it.

    So basically read through 10 or so pages of POPLA appeals? Then use the appropriate sticky thread #3 (pay and display machines) and send that to POPLA?

    Reading the last 10 pages in the PE decisions thread is just to convince you that PE do indeed cancel every single time they see our appeals. You are worrying too much and I thought if you read the recent PE decisions you'd share our confidence!

    And if you look at a thread near yours on this page of new threads right now - this minute - there's another newbie who has got the same sort of PCN as you in a P&D car park, and has just posted up their planned POPLA appeal.
