Put it in writing by email or snail mail now, that if they get a letter can they let you know within days because you are going to appeal so that they have zero liability and the risk will be entirely yours. Tell them that at an Airport site you've learnt there never is any liability for keepers or owners for various reasons but the letter may look as if the opposite is true. In any case as there is no keeper liability in this case, this is a matter for you as driver to handle from start to finish and the fake PCN is not to be paid under any circumstances. Tell them it is not like a Council PCN and cannot be aimed at them, not even under the Protection of Freedoms Act, due to the fact it was an Airport site, you've researched and found that Act does not apply.

P.S. there is no 'risk' with this PCN but the point is, you tell the garage (in writing, not by phone!) that you are taking 'the risk of the PCN' away from their liability because that's what they will be concerned about.

So just a couple of questions. If I do get the parking notice then will I be appealing against the fact that the amount is unfair because I was blatantly stopped where I wasn't supposed to so why would they accept the appeal? Also if I ask the registered keeper to give them my details does it matter if the address I give is not my official address? Everything is registered to my parents address but I don't live there and I don't want them to see it

just read the template letter in the newbies sticky thread to read what the appeal is based on for the PPC (for all of them as its the same)

just search for a recent JLA popla appeal to see what is appealed at popla which includes all kinds of legal challenges but also includes the 3 main points of the template letter

the more you read, the more you will understand

any serviceable address can be used

nobody is saying they will accept the appeal, they either will, or they wont , if they wont, they have to let you appeal to popla which costs them money , so they have to decide if its worth pursuing or not

You will be sending template appeals from the newbies thread, which will win, we know, we've proved they are winners every time*. And you can give any address for service, your choice, as long as you are certain the garage will pass you the PCN in time. If you are going to get one it will be in a couple of weeks I expect. So the garage can either pass the PCN straight to you and you then send the reply by way of appeal (with your name and address saying you were the 'keeper' as defined in the POFA 2012, on the date in question), or they must write to the PPC giving your name and address.

Personally I would favour the former approach, because you want to use a different address than they might give by mistake, and because if you ask the garage to supply your details they'll probably name you as 'the driver' which isn't ideal. You are the keeper (not the registered keeper though).

    * Being blatantly bang to rights makes no odds. We win! You will too!

You blatantly stopped on red lines which VCS painted, there is a perfectly legal way to discourage any misdemeanour's at JLA. Police and Byelaws.

VCS's claim for Airport security is a load of rollocks, you're local look at Hale road. Plenty of cars parked/stopped there, much nearer the terminal/apron.

Their only reason as with the adjoining industrial estate is to fleece people.
  • I was reading this forum because I had exactly the same problem but I don't find the newbies thread you are speaking about with all the steps to follow.
Can you please send me the link?
Can you please send me also the form to send to challenge the PCN?
  • you are about the 4th person to ask about VCS this evening , link to newbies thread: https://forums.moneysavingexpert.com/discussion/4816822

however , just try typing VCS JLA into the forum search box , or even google ,

No form to fill out, just copy and paste the initial appeal in post #1. But this isn't just an easy job of copy and paste and all is well. You need to read, digest, understand and act on the advice given in the sticky.

Come back if you need any clarification on any point. But you need to start a new thread of your own, otherwise regulars will be disinclined to provide further advice. Forum rules, OK!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
