Stewart Milne Homes - a warning from history

Just wanted to warn anyone buying a flat with Stewart Milne homes - they are trying to duck out of the two year warranty agreement over what I would call quite a major issue with my flat.
When I moved into my new Stewart Milne built flat just over a year ago I had to meet the site manager after the first week I moved into the flat.
I noticed that a drain outside my bedroom window had really bad mould and staining so pointed it out to the site manager. He said he would look into it but his snagging list form only covered internals and not communal areas.
After the first month I had another meeting with the Site manager and again raised it. He gave me the same excuse that his form only covered internals but it would be dealt with. A neighbour was also given this whole "internals only" issue when he moved in.
I then decided to e-mail the area manager in April (12 months into my stay) about it and he replied saying communal issues have to be reported to the factor. When I first reported the problem, the factor hadn't taken ownership of the site. Eventually the factor gets back to me and says Stewart Milne are denying liability as its caused by the weather and is expected. I don't dispute that this would happen over time even with a normal working drain pipe but it was like this when I moved in and Stewart Milne staff were always ducking out of documenting this.
I spoke to the area manager again and he is denying liability saying it is a maintenance issue - I am still only 18 months into the 2 year warranty. I think it will cost at least a couple of thousand to repair as it will need scaffolding erected before repairs can even start.
I've already contacted NHBC about it and they've initially said that Stewart Milne need to fix it but my understanding is Stewart Milne can dispute it and NHBC potentially could side with them.
So if anyone is considering buying from them - you could have similar issues!
