Even if your partner is/was reported - it isn't a police matter. Perhaps the Data Commissioner would feel differently, but from what you say, an individual doing this for no financial gain is not going to get their attention.

Vodafone were misled into believing they had the authorisation to do what they did, if this meant there was some incompetence, even that is allowable. The fact your password was guessed is an issue for you alone, and I suggest you replace all your passwords with something nobody can guess.

No, it is because they assured me there would be no online access. That is neither mine nor my partners fault that they decided not to block it as they said they could and would.

I would like to know if I have any form of a case to request financial compensation as the apology they have offered does not go any way to ease the distress it has caused.

Oh I see you're blaming Vodafone because you think it's an easy way to get money.

You're not going to like most of the replies on this thread I suspect but them you shouldn't look to try and get cash out of something that's basically your fault.

Judging by previous posts OP is a 'she' so probably not a Mistress on the side (unless she stays in Premier Inns regularly :rotfl:)

It's her fault for fraudulently setting up a Vodafone account. Do you have no concept of taking responsibility?

Yes it is - Data Protection Act offences (although some can be charged criminally) are generally are dealt with by the ICO, but Computer Misuse Act Offences (also often known as hacking) are most definitely criminal and can be dealt with by police, and regularly are.

Dont think the courts would want involved in this one.

From DPA perspective....it would be reasonable for vodafone to assume it was the OP since validation probably would've went to their email address and/or phone. Certainly anytime I've had to set up an account with a network operator, its been that way.

If OP has given access to their email, I fail to see how having access to their phone bill would cause distress. Either you trust someone to have access to your accounts or you dont. Plus it should be common sense that if someone has access to your email address.....they will be able to set accounts up in your name and gain access to your existing online accounts.

And lastly.....how did the partner set up the account? If they done it online then it would be automated and no human interaction from their side. If it was over the phone then I can see where OP's complaint is.....but still don't think any compensation is due as there has been no loss and vodafone likely had no reason to believe the partner wasnt allowed access if they passed the security questions.
You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride
