We've read it on the day of course...dreadful decision in favour of the bully-boys, absolutely awful. But then the Supreme Court tweeted the decision only applied to THAT car park and with THOSE signs...
But many Judges will not see the difference unless you show the differences clearly and have other facts to argue on. Even then I think most people will lose, thanks to those Judges. Ridiculously unfair and punitive - but apparently OK if you earn a fortune and didn't bother to ask Barry Beavis why he even overstayed and assumed he just needed a new watch.

The inevitable has occurred and PE Ltd is continuing to proceed with the case. Court date set near the end of January 2016. The Court venue has changed.
I am just going through the rewrite of combined Witness Statement and Defence to include the SC ruling on Beavis.
(That'll keep me busy and allow me to avoid the Crimble mayhem, bah humbug! Aargh, Musak, adverts and all that tosh.)
Can anyone point me to the latest standard PE Ltd contract on the web, please?
I'll let everyone know the Court and points I am trying to defend on closer to the time. I am hoping that a few technicalities may be sufficient, because of course our circumstances are different to those of Barry Beavis.

You might want to have a root through the PE cases linked via the Prankster's Case Law page of his website.

In addition, why not drop him an email to ask if he has a recent one. Whatever you get will be full of large black blocks of redacted information. You might want to press on this with the Judge if you get such a heavily redacted contract at your court case.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Yes I have seen the typical PE Ltd contract from a FOI request as ex002 in his Exhibits section, unfortunately this is dated 2011. I thought that there might be something more recent out there.
I have a variation to contract from them for our car park in question, which of course is well redacted and refers to another contract document. I was hoping to get a glimpse if one exists to see if what was referred to was in it, it is not in ex002.
I requested that PE Ltd provide one but again of course no such playing ball as per the Practice Directions so I shall ensure that I point out all their failures to abide if the Judge will let me speak!

ParkingEye Ltd have notched up another one.
How could I be so presumptuous and think that after the Supreme Court ruling on Beavis another ordinary person might be successful at Court.
It has set the precedent.
It became pretty obvious from the outset that we were on a hiding to nothing.
Our points were noted but none accepted.

Bad news.
For the benefit of others undecided whether or not to defend a county court claim off them could you let us know how much extra you ended up paying by going to court rather than paying up when the court claim first arrived (ie before you defended it)0 -

It looks like you were "done" on one of the old defences.
Newer ones will come along after a few loses - which was the case before.

Hello Forum can anyone help?
I parked in a Parkingeye monitored car park from 6.50am on 26/12 for over 2 hours, I was unaware the parking cameras were operating over the bank holiday weekend.
I received a letter of £60 fine and I appealed explaining I didn't realise the system worked on a bank holiday weekend plus the signs do not indicate what time the 2 hours start because I left the car park approx. at 8.45am before the so called peak time. It was dark in the morning when I parked. The signs don't say they operate 24/7 or from 8am -8pm. it just says 2 hours.
I have already appealed explaining that I didn't realise the system was operating on a bank holiday weekend and the signs do not indicate timing of parking. Now they are requesting receipts of purchase but I went to shops cross the road, not to the ones in the small retail area plus they are not open that early.
What should I do?
