"new" LG G3 shipped from mobiles.co.uk with ripped open box which is resealed 3 times

Bought a new phone on contract from mobiles.co.uk, next day the phone arrived. Box is ripped open, seal sticker is applied three times on top of each other. In the box battery bag is resealed too (sticker on top of original one), earphones bag is tampered with too. I phoned customer services to request a replacement but they keep saying that the phone is brand new (according to their database) and hasn't been sold before. They even refuse to exchange the phone to another one.
Has anyone had similar issues with them?
I've requested return and waiting for confirmation, but does it mean that they always sell refurbished stuff as new? And why refuse to send replacement?

You bought at a distance, they cannot refuse your return.0

They sell a lot of "refurbished" phones, by which they simply mean phones returned to them unused. They always make this clear at the point of sale where this is the case. Seals are put on by manufacturers, so I can't see how Mobiles.co could have done this. If you're unhappy and haven't used the phone or sim you have the right to return it within 7 days (unless it was a so- called upgrade).0

Yes, that's a good point, however I find it outrageous that box was sent ripped open which doen't prevent anyone from opening it without damaging the seal and tampering with content.0
