I have contacted fast track reclaim last year to see if I have any PPI to claim back.

in October of last year I had a payment of £1800 go in to my bank and the statement said PPI repayment. I had no letter, text, email or phone call in regard to this money so assumed it was fast track doing their job and recovering money.

fast forward to April this year and I get a text saying good news I have a payment due from Barclays for £1800 coming. Shortly after I recieved a letter saying I owe £540 for the £1800 payment. I thought ok to get this payment of £1800 I need to pay their fee then I will get the remainder but it turned out there was no more money to come and this £540 was fees I have to pay for the money recieved in October.

I no longer gave any of the money left as it was spent on bills and was not told it wasn't mine to spend. I put a complaint in and it turned out to being Barclays fault for not sending a final decision letter out.

but even though its Barclays fault 6 months later I'm still being chased by fast track for the £540 I no longer have.

what can I do? Thanks for any help you provide.

Worst Barclays may have been at fault so were you for not checking the handler's fee had been paid. They did their job, you need to pay their fee.

So its acceptable after 6 months and not being told they hadn't taken their fees that I still have to find the money and pay them.

I assumed that fast track had taken their fees and put the remaining £1800 in my account as no one for 6 months said anything.

It is, yes. Where money is concerned you should not assume anything.
  • They can have £10 a month then for 54 months.

They can take you to court and get a CCJ against you.

Contact them and discuss a reasonable payment plan.
  • Ok thanks, I will try and get the payment lowered as they messed up in my eyes waiting so long to ask for payment.

Wouldn't hold your breath, they will have a watertight contract and terms and conditions that will say you will have to pay them.

2.3 FTR will progress the claim until a final conclusion is reached. Where that conclusion is successful FTR will be entitled to charge a fee in line with that agreed under clause 3 entitled ‘FTR Fees’ below.
--no mention of a time limit to charge

You employed them to do (very little) work needed for the reclaim and the contract you signed will have said you read the T&Cs which include the below:

3.4 Where fees remain unpaid and FTR are forced to either take court action or appoint a debt collection agency to recover outstanding monies FTR reserve the right to increase the amount owed by an amount equivalent to the cost of that recovery. A court may also award additional cost and/or statutory interest at the rate of 8% above Bank of England base rate

Sam Vimes' Boots Theory of Socioeconomic Unfairness:

People are rich because they spend less money. A poor man buys $10 boots that last a season or two before he's walking in wet shoes and has to buy another pair. A rich man buys $50 boots that are made better and give him 10 years of dry feet. The poor man has spent $100 over those 10 years and still has wet feet.

  • I'm in a similar position. FT were instructed by me in 7 claims. 2 settled and 5 said I had no PPI and so FT didn't pursue it (despite my proving I had PPI with one firm, Amex)

A year later M and S sent me a Cheque for £5K plus, saying thay'd miscalculated. They also told FT, no longer instructed, and they demanded a cut. Recently Barclaycard also got in touch, said they'd made a mistake, I did have PPI after all, and sent me £21K! FT wanted a cut of that too.

I instructed solicitors and M and S provided a letter saying the extra cash didn't come after any further work by FT.

FT never provided any evidence of actually issuing proceedings nor have the provided proof of any negotiations for me. It seems that they always accept the lenders figures and don't argue, nor do they argue if the lender refuses my claim. I believe they have not acted in my best interests throughout but rather in their own

FT are now suing me, through Quickly Finance, for over £8K. I've taken counsel's advice, which is that FT will succeed. Has anyone else been sued or instructed a solicitor successfully and defended such a claim?
