Cascade Financial Ltd-PCN

Hi I have recieved a PCN from Cascade Financial Ltd posing as National Parking Control. "The Civil enforcement notice 1" is the exact same as the one shown in this thread

I am going to send of the general template letters to Cascade Financial, DVLA and BPA. I have just sent out a complaint also to the Dukes theatre-the people who use Cascade and where they say my car was parked.

One query however on my PCN form it states my car was parked at the Dukes Theatre, Moor Lane, Lancaster. My car was actually parked at Brewery Lane Lancaster? There is also nothing on the form in relation to how long my car was parked etc?

Are these guys for real-no warning nothing-also from the forums I am getting no contract has taken place and so technically no legal standing?

Finally can these guys tke you to court and can they affect your credit rating? I am due to go for a mortgage at the end of the year and would not be good if this was on there!

Any advice would be appreciated.

    This means you have a non complaint ntk. Or are you appealing a windscreen PCN in which case you should wait for the NTK?

    Yes, the scum can take you to court (and do). Your credit rating will only be affected if they obtain a CCJ against you and you then don't pay the debt straight away. Other than that, they can't affect your credit rating.

    TBH That's such a shocking Notice that I would list all the things wrong with it and email the BPA and the DVLA (same email copied to both) and ask them:

    'Please explain to me how this bunch of jokers using this version of a Notice, littered with all the flaws mentioned above, nothing from POFA 2012, nothing about the alleged contravention at all and a wholly misleading heading on the back about 'keeper liability' which then talks about something completely different, managed to:

    (a) get accepted as an AOS member
    (b) get this insult of a NTK past you
    (c) get past the requirements for a KADOE agreement and
    (d) managed to convince the DVLA to release data based on this diabolical rubbish.'

    Then forward a copy of the same sort of message to the PPC as your appeal showing all the flaws and telling them they've been reported to the DVLA and the BPA for serious breaches of their KADOE contract and the BPA Code of Practice.

    Email addies for the BPA and DVLA are in the top thread.

    So I was going to use the basic template from the front beginners thread to send to the PPC, however should I just list everything that is wrong with the notice which I was going to send to DVLA and BPA and also send this to the PPC? Naturally I have sent an email of complaint to the owner of the dukes theatre stating my concerns this cretin now has my address.

    I have received a parking 'invoice’ impersonating a parking ticket from a company called National Parking Control - Cascade financial Ltd - PCN number: npc003524. This erroneous ‘Notice To Keeper’, which is not POFA compliant, states 'keeper liability' and utterly misleads the recipient. I have written to the company in question to complain, but have had no response. My specific point of complaint are:
    1. Impersonation of authority by using the words "enforcement", "fixed", "offence" and "court summons".
    2. States categorically "Legal action will be taken for unpaid tickets". I do not believe this statement to be true.
    3. Threat of late payment charges is a breach of the BPA AOS Code of Practice.
    4. States that "All credit reference agencies will also be advised to register the debt". The operator has no such power therefore this statement is untrue.
    5. States that "The vehicle owner is responsible for the payment of this ticket". This is untrue.
    6. Keeper liability is alleged when this is untrue as a result of the failure of the Notice to Keeper to comply with POFA 2012 Schedule 4. Specifically:
    - there was no Notice to Driver attached to the vehicle, and the Notice to Keeper does not claim that there was.
    - the Notice to Keeper does not identify the creditor
    - the Notice to Keeper does not state the period of parking
    - the Notice to Keeper does not state the means by which parking terms and charges arising were brought to the driver's attention.
    7. An appeal was sent in response to the Notice to Keeper, but no PoPLA code was issued, only another notice exhibiting much the same defects as listed above.
    8. The address displayed on the PCF is wrong and is shown as Moor Lane, Lancaster when the piece of land in question is actually Brewery Lane, Lancaster.
    Please explain to me how this company using this version of a Notice, littered with all the flaws mentioned above, nothing from POFA 2012, nothing about the alleged contravention at all and a wholly misleading heading on the back about 'keeper liability' which then talks about something completely different, managed to:
