@bazster, I understand what you're saying, it's all new to me so at times I will ask questions that are to some members very easy to answer.
For example what is FOI? Should I know this? Do I need to go over forum posts for newbies again? I have read the newbies post, just times I come back because you will see what others and myself miss.
Other than that, this website will of been a godsend when hopefully this all comes to an end

Fawkes,
Just one thing - it looks like Paul Hodgkiss was jailed in May 2002 (rather than 2007) - wouldn't want you to get facts wrong if/when you raise this.0 -
The thing is, your next complaint to DVLA is on different grounds. You are complaining that:
(i) the company might have a jailbird for a director and, if so, its KADOE contract (if any) can't be valid because the declaration of good standing can't have been made truthfully and
(ii) BPA Ltd. (a DVLA-accredited trade association) appears to be admitting newly-incorporated companies into its Approved Operator Scheme without any audits or checks whatsoever, and is fobbing off complaints by claiming it's merely a name-change, which demonstrates either breathtaking stupidity or breathtaking dishonesty on the part of BPA Ltd.
Given what you have been told by BPA Ltd. it is doubtful whether Car Park Management Services (CPMS) Ltd. was ever properly and lawfully admitted to BPA membership or to the Approved Operator Scheme, and if this is the case then any release of data to it by DVLA would be a clear breach of the Data Protection Act.
Obviously since the latter is a complaint about BPA Ltd. it cannot be investigated by BPA Ltd.Je suis Charlie.0 -
Do you think they will possibly ask for the ticket to be cancelled or do you think they will be forwarding my appeal letter for a POPLA code to be sent?
The best you're going to get as a direct result of any BPA intervention is a POPLA code, although there have been, from vague recollection, one or two where the PPC has thrown its hand in and given up.
No harm in trying though! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Hi guys.
What happens if you POPLA code has been wasted...
Your appeal route to POPLA has been wasted, and the one golden opportunity you had to kick this charge permanently into touch.
Are you really saying that after all that correspondence with the BPA, you finally received a POPLA code, but you've now missed the deadline? Please note, we are not a legal advice forum. Think I strongly disagree with your reply. Would not say at all my "golden opportunity" has gone. I would say I've missed a good enough chance but POPLA are in bed with them anyway.
What other options do you have? I may have missed something here. Unfortunately your thread is over 100 posts in size and no one is likely to be reading back over almost 3 months of inputs to try to get a full understanding.
Regulars are dealing with dozens upon dozens of threads daily, so we have to pick things up from the most recent posts in each and give advice as we see it at that point.
So if I've missed anything where you have found better opportunities than POPLA to get rid of this, please put the details here, and we can move on from there. Please note, we are not a legal advice forum. Judge and jury? Prison? This is a civil matter and if it gets to litigation will be dealt with by a small claims court.
If you think the lottery of the SCC is preferable to the near certainty of success at POPLA, then you don't understand the issue.
In view of your opinion of my advice, I'll wish you good luck - I'm out! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
