    Just one thing - it looks like Paul Hodgkiss was jailed in May 2002 (rather than 2007) - wouldn't want you to get facts wrong if/when you raise this.

    The thing is, your next complaint to DVLA is on different grounds. You are complaining that:

    (i) the company might have a jailbird for a director and, if so, its KADOE contract (if any) can't be valid because the declaration of good standing can't have been made truthfully and

    (ii) BPA Ltd. (a DVLA-accredited trade association) appears to be admitting newly-incorporated companies into its Approved Operator Scheme without any audits or checks whatsoever, and is fobbing off complaints by claiming it's merely a name-change, which demonstrates either breathtaking stupidity or breathtaking dishonesty on the part of BPA Ltd.

    Given what you have been told by BPA Ltd. it is doubtful whether Car Park Management Services (CPMS) Ltd. was ever properly and lawfully admitted to BPA membership or to the Approved Operator Scheme, and if this is the case then any release of data to it by DVLA would be a clear breach of the Data Protection Act.


    Obviously since the latter is a complaint about BPA Ltd. it cannot be investigated by BPA Ltd.

    Do you think they will possibly ask for the ticket to be cancelled or do you think they will be forwarding my appeal letter for a POPLA code to be sent?

    The best you're going to get as a direct result of any BPA intervention is a POPLA code, although there have been, from vague recollection, one or two where the PPC has thrown its hand in and given up.

    No harm in trying though!

    Judge and jury? Prison? This is a civil matter and if it gets to litigation will be dealt with by a small claims court.

    If you think the lottery of the SCC is preferable to the near certainty of success at POPLA, then you don't understand the issue.
