  • I just spoken to OFCOM, it seems I've been the victim of 'slamming' which is illegal. I've registered a complaint.

If you did get told it was "slamming" it must have been a mistake and I can't see anything coming of it.

Slamming is where they change provider without telling you.

As you didn't have a contract in the first place and as the contract is the same provider as your PAYG neither has happened.

Even if you did put a complaint in OFCOM don't take on individual cases, which means it's down to you to sort out.

Miss selling maybe but more likely a mistake and nothing more. Although I'd have thought it's unusual for a network to supply a contract sim without doing credit checks bank details etc.
It's not just about the money

No signature is necessary in this or any other contract, for a contract to exist. The sig just offers a proof.
In this instance the supplier confirmed the contract details in writing, but you chose to ignore it. Much harder to dispute now 3 months down the line.
First step is a letter by RD to the supplier headed 'complaint'. The regulator won't be interested until you have exhausted the supplier's own complaints procedure, a process that you haven't yet begun. Such a letter starts the clock ticking.
No free lunch, and no free laptop ;)
  • crazy laws because as OP could state that she never received the sim (as it wasn't activated or signed for how could EE dispute this?)
that cannot constitute a contract surely?
  • Hi Paul,
Exactly the same happened to me.
I have sent multiple letters and emails of complaint and have now received a 'formal demand' for payment from a debt collector for the amount they say I owe on a totally mis-sold contract which I didn't want, was just sent the sim card, I never registered it and have never used it.

I have received no reply from Orange at all and this has been going on since February.
I can't offer you any advice as I am still in the midst of it but just wanted you to know that you are not alone, it has happened to me too.

It's awful. I have just another letter from the debt collectors this morning so I will have to phone them again tomorrow.
Good luck with your situation - I would appreciate any helpful info you may come across please :-)
