    missbigles , my pension pays the mortgage, not a high one thank fully, ful council tax also as i have my pension ..

    Unless your mortgage is tiny, I would've thought that your pension would affect your CB ESA claim. Can I ask how much you get?
  • Yes thats my thoughts also that I would get no help as have a £400 pension monthly .

    Assuming your pension is £100 pw, you should have had a deduction of £7.50 from your CB ESA. Did you declare your pension?
  • The form is on its way, not here yet but yes will be declaring it .. If you say the £7.50 reduction from CB ESA that would be weekly yes?

    How will this woman know how many bank accounts you have and how much is in each one?
    How will she know how much you get in Pension and who the pension providor is and the pension ref No.
    And who your mortgage lender is and how long you have had a mortgage and the mortgage account number?.

    You cannot sign a blank form and let someone else fill it in for you, if anything was wrong on the form the DWP will come after you for the repayment of overpaid benefit, and it will be too late to say..... "But I just signed the form someone else filled it in for me".

    As to your appeal You need to phone ESA and ask them to send you a GL24 or try and download one online and while you are on the phone to them ask them what was the date of the WRAG decision.

    Whilst it may not be too late yet to send an appeal it is VERY close to being too late and you need to act fast. It could actually be already too late, the 13 months runs from the date of the decision to put you in WRAG, the decision could have been taken quite a while before September 2013. September 2013 was just the date you started getting paid ESA from. You should have had a letter in 2013 telling you you have been placed in the WRAG.,,, The date of that letter is usually the date of the decision and your 13 months runs from that date. If you do write an appeal, you should ask for an appointment at a jobcentre to have the appeal sent electronically.

    You won't be entitled to much ESA IR (maybe a couple of pounds a week) but you will also get help with your mortgage and the mortgage help should be backdated to the start of your ESA Conts period i.e. a year ago...but there may be a 3 month period where it the mortgage is not paid at the start of your claim.
  • thank you pmlindyloo. due to memory issues ( even had to have a brain scan ) I have looked at the page and can see me in 3 of the areas. CPN filled in my form, never heard anything back , it is in my mind to ask her what forms she done for me , no phone call today from her and not due to see her till 5th Sep.

  • Thanks for link and advice epitome, yes agree perhaps to late , could I handle the stress of it all I very much doubt it ..
    ESA 3 may be the only option for me , having the monthly pension coming in it would probably be classed as enough to live on , yes with my ESA CB and pension it has , have paid all in full mortgage council tax etc , if they take that away then im struggling ...

    Yes, that would be weekly.

    Does that mean you haven't been declaring your pension for the year you've been on CB ESA?
  • Yes have declared all missbiggles , that's the reason I received no help re mortgage and council tax as income to high . The pension enables me to pay what im meant too and manage no problem , it is when they take it away the struggle will begin..
