Please Help me im sick with worry :(

Hi Guys
I came home yesterday to a brown letter. It was a letter from a company called parking eye demanding £100. I went on holiday in june and it relates back to then. I know why they think I hadn't paid is because when my girlfriend paid for parking she missed the '0' on the end of typing in my reg so I guess it picked up my car. Im confused because its been a gd 6 weeks since then. im going out of my head with worry as I cant afford £100. Please can anyone help.

Thanks

You and about 800,000 others will get those envelopes this year.

If you'd bothered to read the NEWBIES thread at the top of the forum before rushing to post, you'd soon realise there's nothing to worry about at all.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

    Ok

    First do not panic.

What is the date of the letter?
Read the Newbie thread and look at post 1 in the first instance. You may just be I time to get the template appeal off to them this afternoon by email.
If so it will then it will be a straightforward job to appeal at POPLA and win.

So tell us what the date is one the letter please.
Newbie thread: go to the top of this page and find these words: Main site > MoneySavingExpert.com Forums > Household & Travel > Motoring > Parking Tickets, Fines & Parking. Click on words Parking Tickets, Fines & Parking. Newbie thread is the first post. Blue New Thread button is just above it to left.

No idea why you are sick with worry nor why you needed to start a new thread about the basic stuff the forum already tells you about. We are guessing you haven't read the forum sticky thread at the top, BEGGING newbies to 'read these FAQS first'?!

As ever, this is covered in the sticky thread at the top of this parking forum - which is why I wrote it. Sadly, last year it got silly as we could not keep up with all the ''help I have got a private parking ticket, what do I do?'' threads. The Newbies advice thread is one click away from ANY thread to get back to the first page of the forum (which to be fair to us is where you must have started but never read any threads). My signature below tells you where to click. Start again and learn what to do to beat this on appeal. EASY.

  • Hi Bargepole I did read the thread before rushing a post....But I couldn't see anywhere on there that was the same situation as mine. It seems letters should or have been sent out before and I haven't received them.

Hi Dee the date of event was 30th June and the letter I have now is dated 7th August

    Thanks for your help

    generally the situation is irrelevant

just submit the shortened template letter on their website, today , NOW !

add an extra point with the reg number you think was typed in and ask them to check it

then complain to the landowner asap and insist on cancellation

ie:- get pro-active, now , today, asap , or sooner

You don't need the same situation as yours, all cases are like yours. At the top of the Newbies thread it starts:

''This isn't a real parking ticket. Don't be scared. The details do not matter! You always have a case to challenge a private parking ticket, whatever the circumstances even if they have photos.''

Nonsense! - Your "situation" (or rather its irrelevance) is amply covered by the very first post in the sticky!

Now please, go back and read it properly and carefully. All you need to deal with PE is there.

If you follow the advice in the Newbies thread, you'll succeed.

This forum's got a 100% success rate at the appeals service called POPLA.

Always remember that you're going to beat them over the head (metaphorically speaking) with legal points - mitigation doesn't get a look in with POPLA's assessors.

    .

Although there was one case recently wasn't there where POPLA refused an appeal based on GPEOL...? :-/

I would appeal to PE with the facts - that the reg was entered incorrectly. Then I would add

"In a recent case in Northampton, the following paragraph was contained in a sworn statement by Jonathan Langham
. Subsequently, ParkingEye received the defendant's defence. The defendant reiterated that he had paid the charge, and that he had been required to enter his registration number. It should be noted that the terms and conditions state that the full and correct vehicle registration number should be entered. ParkingEye does check to ensure that we do not issue charges to motorists if it appears as though a slightly incorrect registration has been entered.

If you examine the records for the day in question, you will see that a registration similar to mine but missing a digit was entered. In view of that, then, in line with the extract from Mr Langham's witness statement which seems to cover my case, I would ask that the charge be cancelled as payment was made, albeit for a slightly incorrectly entered registration".
