  • Thanks!

However, it appears the owner has done b*gger-all, so I'll get Mum to speak to him again.

    Cheers all, really appreciate it.

''The operator wanted to give every opportunity to transfer liability to the driver.''

Yep...sure they did! They really mean:

'The operator wanted to find out who the driver was so they could take them to court as that's much easier for them than chasing a keeper under the POFA. Delaying a rejection letter & POPLA code - and asking who was driving again - is a specific breach of the BPA Code of Practice but this is ParkingEye, they pay a lot of money to the BPA (we think they are a shining example due to the Beavis case) and we want to keep them sweet, so we've just nudged them for a POPLA code, no slap on the wrist needed'.

Use one of our templates for a PE POPLA appeal (from post #3 of the Newbies thread) your Mum has nothing to worry about at all.

Makes you wonder how many small businesses will 'swallow' what PE are dishing out to their customers by being reluctant/tardy in tackling them on their behalf.

Meanwhile their business slides slowly and silently nearer the precipice.

  • Cheers all, just composing a letter now.

I can't see where I have to send it to though - does anyone have an address? Also, I have yet to receive an 'official' letter from PE stating that they do not accept the appeal we made. Best I wait for this, I assume?

Please save me trawling back through the thread - who are you writing to, and for what purpose?

It's for POPLA, trying to get off a ParkingEye charge.

    Are you formally appealing?

Have you used the POPLA appeal templates from post #3 of the NEWBIES sticky to develop your appeal?

Are you using technical and legal points, or are you hoping your 'story' will suffice (it most definitely won't)?

Are you going to flash up your draft here for us to critique so you know you have the best chance of winning?

Here's the POPLA 'Contact Us' page. Did you try Google?

Try the POPLA website! Look for 'making an appeal'. But don't rush it, why not just wait for the letter next week, and show us your draft first?
