ParkingEye - new tactic?

Hi all,
First of all, I should point out that I'm doing this on behalf of my Mum (because I'm good like that!).
OK, so she and my sisters went on holiday to Cornwall about a month ago. They actually overstayed the stay in a car park by a few minutes due to slow service in the restaurant they were in, and subsequently received a letter from PE.
I completed the appeal details as per the suggestions on here, and we even contacted the owner of the restaurant who agreed it was unacceptable and he would get it cancelled.
Today we've received a letter or two from PE, and they cite several court cases, and are demanding we tell them who the driver of the car is or they'll (basically) send bailiffs round.
They have placed the charge on hold for 14 days so we can provide further evidence, and there's no POPLA reference as I requested.
Anyone have any ideas of next steps...? My mum's starting to get very very worried!

You respond as keeper saying that you have nothing further to add to the appeal and they should either cancel the charge or reject it and issue you with a POPLA code.

They can't send bailiffs around -until you are found to owe them something in a court of law and then fail to pay anything THE COURT states (not anyone else) you don't have a debt to them.
No debt- no bailiff.Unless specifically stated all posts by me are my own considered opinion.

Respond back saying that they don't need the driver details, and ask if they know what the Protection of Freedoms Act 2012 is. Tell them to read it if they have the intelligence to understand long words, if they don't ask them to get their so called legal department to explain it in little 2 syllable words that they may comprehend.
Then make a scan of the letter and make complaints to the dvla and bpa about the breach of pofa 2012 by them, then wait for the reply off all of them.When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

as above, to stop this from happening we need anybody who gets this shabby and unprofessional treatment to complain directly to the BPA and the dvla with copies of the PPC paperwork etc
so report them asap, details in post #6 of the NEWBIES sticky thread at the top of the forum
then take them to popla and spank them there for £27 + vat once you get a popla code, using post #3 link in the NEWBIES sticky thread and help from forum members here0 -
It's not a new tactic, they try this sometimes and a complaint should be emailed to the BPA every time PE try it. The email addy for the BPA is in post #6 of the NEWBIES thread.
As long as you get your POPLA code shortly and then use one of our templates for a PE POPLA appeal (from post #3 of the Newbies thread) your Mum has nothing to worry about at all.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi again,
Just received an email from the BPA:
"We have investigated your complaint with the operator and can advise as follows.
Parking Eye have confirmed they sent a reminder letter on the 26th July 2014 as they had not received any correspondence from the driver or the keeper. A website appeal was received on the 31st July 2014 stating the driver was a genuine customer and the charge is not a genuine pre-estimate of loss.
Parking Eye contend they did not reject the appeal at first as they asked for further evidence. Parking Eye responded asking for driver details as the correspondence they received advised the person appealing was not the driver. The operator wanted to give every opportunity to transfer liability to the driver.
Parking Eye have received a further appeal and therefore on the 19th August 2014 this was rejected and a POPLA Code was issued. The POPLA Code is xxxxx. If you wish to contest the matter further, please use this code to appeal to POPLA.
In view of the above I have closed the investigation.
Thank you for bringing this matter to my attention."
Looks like I have to appeal it with POPLA now. Grrrr!0 -

I'd resurrect, if only for extra input to POPLA.
'The only communication the RK expected was confirmation of cancellation, as dealt with by the restaurant Mgr, Mr Joe Bloggs, as he advised us, on [date]'
Whether or not he did is another matter. If he did, he can be very cross, tsk tsk. If not, you took him at his word, accepting his authority.
