Hi, I've just received my first letter from CRS, just like all the other posts I have apparently not responded to the other letters...which I didn't receive! As a result fees of £102.50 have been added meaning I now owe a debt of £207.47!
Now I cancelled my xercise4less membership in March on a web form. I even got a confirmation email...however I deleted it just a few weeks ago! I massively kicking myself for that now.
So I rang Harlanss this morning and they said they never received the cancellation notice from the gym so I spoke to membership arrears at xercise4less who said the cancellation form goes to the gym and they have to send it to head office. I then rang the gym who said the exact opposite! The nice lady at the gym has emailed head office to investigate so I'm waiting for a call back next week.
I did move address just before I cancelled but I didn't tell Harlands because as far as I was concerned, I'd cancelled my membership and paid my last payment in march.
In hindsight, I wish I had saved the email and I wish I hadn't cancelled the direct debit as I now wouldn't be in this mess, but I don't feel I should have to pay £207.47 for the last 3 months because I didn't save an email!
I feel fairly certain the head office are going to claim they never got the form even tho they sent me an email to confirm at the time. I feel like the only way I will get this sorted is by paying them but I don't see why I should and I don't have the money anyway!
    I'm so upset and frustrated!
Any advice would be gratefully received!
    Thanks

    Hi,

You certainly should not pay a debt you do not owe !!!

What email client do you have ?

In Outlook, you can recover deleted emails from so far back, not sure how far though.

Anyway, that's bye the bye, stay off the phone to these people, that's how mistakes are made in the first place.
You need to take the initiative here write a stern letter of complaint to both parties, stating that there internal procedures are absolutely nothing to do with you, you cancelled correctly, and you expect this matter to be dropped immediately.

You will not pay a debt you are not responsible for, and if they choose to take legal action over this, it will be rigorously defended, and will result in a counter claim been issued against both parties.

Do not be dissuaded, just because they are big companies does not mean they have any legal right to harass you, stand up to them, do not be walked over.

The onus is on them to prove a debt exists, not on you to prove it doesn't.

If you letter from CRS contains unfairly levied fees or is based on incorrect facts, write to them inviting the court action. They actually do know that it is not in their interests to take spurious cases through the courts.
For them, it is just a 'numbers game', with a rack of low paid youngsters pressing buttons and issuing template letters, according to a prescribed system.
If you challenge the facts and make it clear that you are happy to have the facts heard at court, they will go away quietly.

    Hi All

V similar issue with these people. I contacted the FCA - Harlands services are no longer required to be registered I was told. Tried to post conversation but as a new member I cant. Clearly there is no resolution whatseover to these companies whilst they continue to make millions of pounds off decent people.

After reading all the comments on CRS I am also have a out standing gym membership fees totallying £120 and fees of £120+

Basically I have gone through hell with payday loans and more over the past 6 years so I am thinking of taking them to court and using there own solicitors before they take action on my account.

I have had enough of crazy fee's in excess of £60.

Very angry upset and ready to give them a taste of there own pie singlying.

I visited my Gym in September after explaining that due to an ongoing knee problem as well as another health concern, I hadnt visited the gym since July. They offered to 'freeze' my membership if I paid an admin fee of £5. I duly did this in the gym, and on the form I requested a 6 month freeze.
Now, me being me, and not wanting to be charged for something I haven't had use of, I cancelled my DD of £19.99pm. The way I see it, why should they have had reason to take the payments, when my membership was 'frozen'?
Within no time at all, Harlands were emailing me and hassling me. Then out of the blue insisting that 3 months was the maximum they could freeze the membership for. That would take me to end of December. Fine, I thought, and my plan was to go in then and unfreeze my membership and set up a new DD for the monthly fee.
But now I've got this off CRS, who clearly ARE part of Harlands. Is this a joke? Suddenly wanting over £200 off me with a £66 admin fee added?
Nah, sorry but no way. I am not even going to respond, I know phoning is a no no...as is any kind of acknowledgement. They can send me as many letters as they like, and Ive just changed my phone anyway so not bothered about them ringing my old number.

These kind of dodgy set ups just amuse me. Same address yet trying it on with a different name....had similar with a parking firm a few years ago cracking on their solicitor was writing to me....again from the same address. To me, this kind of behaviour is fraudulent and misleading.

So, 1, I am not going to lose sleep over these clowns.
And 2, whatever happens Ive been out of work since June, trying to A-sort my knee out, and B-get another job. (Over 300 applied for, had 2 interviews). Basically, I'm skint. Not entitled to benefits, so no money at all. Even if I wanted to pay and resolve, I cant do. So there we go.

Can I just add a few things to people who are being hassled in similar circumstances.

1, don't panic! These things are ten a penny.
2, do not get on phone to them, itll be the worst thing you can do! If they get your number when you call, theyll hassle you non stop.
    3. Do not email or write to them. Same as above. They may write increasingly threatening letters to you. They WILL do. Its their job and aim to get money out of you. Just be a bit thick skinned and ride the storm. Youll soon recognise their letters in the mail, just bin them straight away.

They prey on making people panic and think they will get taken to court. You won't be. You will get a letter eventually off a 'solicitor'. Again, this will be some other department of Harlands or connected to them. Regarding Harlands, I even sent a photo of an hospital appointment regarding my health problem, as per their request. Hasnt stopped them. Unscrupulous, dodgy company they are. Ignore them big time.

We have been arguing with this company and now have sufficient evidence that they are hiding away that the gym didn’t contact the DD company Harlands so they taken payements. Now had confirmation that the date on there systems say that the DD was set up on this date but the bank have confirmed this is not the case. Told them to be happy for them to take legal action. I get a reply that they noted my comments but the outstanding debt still stands and will take further action to collect these funds. I now have refused to reply to any emails from them and made it clear that this balance is not outstanding.

After a 4 year absence from my letter box they've reappeared adding another £36

They are just trying their luck, I would check to see if it's even referenced on your credit history I can't see it on mine I'll have a deeper dig though.
