Excel parking fine from 4 yrs ago, now passed to Rossendales

Hi. Four years ago I received a PCN from Excel parking. Initially I appealed their ticket as I was a regular user and had been delayed on the train but they rejected my appeal (have never parked there again and I reckon they've lost nearly £2k in revenue from us alone as my DH no longer uses them either). On the advice of this forum I ignored it and went through the various letters from 'solicitors' etc. Have heard nothing for the last 3.5 years but today got a letter from Rossendales saying they will commence recovery action. As this was before POPLA what should I do?

Ignore them, their recovery process includes sending letters and if they got your phone number harassing you to pay, and that's it they cannot go furtherWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

same here. Received a letter this morning from Rossendales out of the blue. Back in 2010 I was being chased for a parking 'fine' by Excel/ Roxburghe/ Graham White. I ignored all contact because the alleged infringement happened in a car park in a place I have never been. I kept all of the letters sent to me back in 2010 and looks like there will be another stream this year.0

the good news is that you are two thirds through the 6 years "sentence" , ie:- the statute on MCOL cases, so they will stop pestering after 2016
just keep all paperwork in a file until the statute runs out
the only letters NOT to ignore are an LBC or an MCOL

Hi, I had a PCN from Excel about 3 years ago and after following the wonderful advice from the people on this Forum I did not pay them.
The letters stopped after a while and then one from Rossendales Collect landed on my doorstep today demanding £150 within 7 days or they will commence recovery proceedings.
So I think that I will just wait and see how many more letters they can send me.0 -

So, how will it play out then? I'm assuming a threat to take me to court, threats of visits etc. but, can you explain why they are powerless and what I should do if they do take me to court? I'm a little worried I'm afraid.
Also, I assume that as I didn't't enter into a financial agreement with excel they can't affect my credit rating unless they get a CCJ?0 -
all they can actually do is refer back to creditor after harassing you for 6 years
if the creditor decides to take it further then they will have to issue an LBC, then an MCOL , if you lost in court with the MCOL and didnt pay within 28 days then a CCJ would ensue and then enforcement
so without a court order there is nothing they can do, hence they are powerless

I'm so pleased I came on the forum today to check this out. I too received a letter this morning from Rossendales which I'm assuming relates to a parking charge I didnt pay back in early 2011. Like the OP, I got a collection of letters from them but ignored their demands. I thought they'd gone away so was really shocked to get the letter this morning & scared as well - I guess that's what they rely on,isnt it?
It's really comforting to read other people have been getting them too. They must be trying to get some money from all the old invoices they sent out.0 -

No, the debt collector has absolutely no power to take you to court: only the land owner can do that, and then only for any provable losses.So, how will it play out then? (I think it's to do with a legal principle called locus standi, but I could be wrong.)
Think of it this way: If I said to you "You owe me 100 quid for this post", would you pay me?
The only way you could get a CCJ on your file is if all of the following steps happen in order:Also, I assume that as I didn't't enter into a financial agreement with excel they can't affect my credit rating unless they get a CCJ?- They take you to court
- You lose
- You don't pay the amount ordered by the judge within the time limit (28 days I think)
