Agree that this is not a contractual charge.
In addition to wording already pointed out by others that indicates it is not, I would also highlight the wording below
"By parking a vehicle in this car park outside of the above terms & conditions the driver agrees to pay a parking charge notice of £100 ...."
A contractual fee must be consideration for something within the terms & conditions of parking.
There can be no contract if what the driver is being asked to pay for is something which is disallowed.0 -

Unfortunately the driver did not purchase a ticket on this occasion - He/she attempted to find a cash machine but didnt have much luck (though later realised that there is one almost directly opposite in the entrance to a shopping centre =d)0 -
Since the agreement seems to be that this is not a contractual charge rather a breach , then it has to be a GPEOL. Within that part of the GPEOL will be the cost of the ticket the driver should have bought, it this will only be a minor part of it. 3 bits of advise I think are necessary,
1) Given the IPC members appeals route is not as tried and tested as the POPLA one, the driver should look to offload this one onto the experts and pay them to look at it. A small one off cost to my mind is money well spent.
2) Fit a dash-cam so you can see your errors of judgement again in full techni-colour. Lock the file on entering and leaving a private car park so you then have evidence to fight an unfair claim.
3) Put a reminder on your dashboard of a PPC mission statement.

This is the car park next to Iceland, I returned to my vehicle today and find a £100 fine for being over the line in the parking bay, this seems really excessive, especially as the parking space that I was a few inches into still had plenty of space for a vehicle and the car park was not full! I was there for just 2 hours with a valid ticket that still had 1 hour to go on my return. Can they go to the dvla to get the address of the car owner (who is not me) they say on the fine that they are accredited IPC operators . I am loathe to pay the "reduced" fee of £60 if I pay in 2 weeks as this still seems still like a lot of money.
I am not the owner of this vehicle, I am insured to drive it, it is road legal and I had permission to drive it. I paid to park there and just feel that this fine is very unfair and am tempted to ignore it , any advice?

I was given a ticket for £100 not for going over my time but for using the wrong ticket apparently. I had parked in the car park (which I now know is MCP). My problem is that when I arrived I was only going to be 15 minutes so I found the closest ticket machine, got a ticket and displayed it on my dashboard as instructed. I returned twenty minutes before the ticket expired and appealed. However after my appeal was rejected it appears that there are 2 car parks on this private land and not one as I thought. As per a previous post it is not clear that this is the case with Iceland offering 1 hour parking for their customers as many retailers do covering the whole car park.. The signage is up on the MCP car park but it is not clear that there is a difference between the ticket machines and I had gone to the nearest as the other nearest was over a wall. Is it also OK that the 2 car parks share 1 entry and 1 exit for the car park? Can you help me with advice - should I pay or not?0

You do need to start a new thread of your own, as we work on the basis of 'one case, one thread' so advice doesn't become confused and/or we have a complete free for all with any number of random cases being tagged on.
But first of all you do need to read thoroughly the NEWBIES FAQS sticky at the top of the forum thread list (one page back from here) which will give all of the initial information you need. It was written by Coupon-mad, one of the country's most knowledgeable people in dealing with private parking tickets. You won't find anything more comprehensive than this anywhere online.
The sticky is detailed and you might need a couple of 'passes' to digest it, so bite sized chunks with a cup of tea over a couple days might be the best approach. You do need to make the effort to do some research via the sticky before asking for further help from regulars - we are so busy each day it's impossible to type and constantly repeat basic information - hence the sticky with all that stuff covered. But do come back after reading it if anything isn't clear to you.

My daughter parked in the car park in Peter st, Carlisle, where she parks every day.
she received a parking charge for £100 as her car was 1ft over front line, she said that the car behind her was into her space, she had no choice as car park was full, of course we have no proof as notice came in post!! its a North West Management car park.
any ideas shall i pay it or ignore as it states you must park within bay, I understand if you take up 2 bays, any help would be greatly appreciated.0
