Hi,my son started a job 2 weeks ago,he gave them all the documentation they asked for, birth certificate, bank card, proof of address etc,now they have told him that they are unable to pay him for his work as he does not have either a driving license,or passport to prove who he is,they say they cannot move from this,as this is now law!!! Is this correct,is it now the law of the land?
He is obviously quite upset about it,can someone please clarify if it is in fact a law that you need photo ID in the form of a license or passport in order to get your pay.Thank-you.

If an employee doesn't have a passport, per HMRC you must provide the following
An official letter or document from a government agency (eg HM Revenue and Customs, Department for Work and Pensions, or the Social Security Agency in Northern Ireland) or previous employer, showing their name and National Insurance number
a full birth or adoption certificate (that shows details of at least one of the birth or adoptive parents)

He has produced the birth cetificate,his P45,proof of address,bank card,he has a Citizen Card,but they won't accept that,who does?
This is crazy,he is English, born here to English parents. Is this law that you MUST have a driving license or passport before your employer can pay you???This should have been made VERY clear at the interview.0 -
Its definately not a law.
you have to confirm they have the right to work in the UK (via birth cert or passport) before you employ someone. however you can't employ them, make them work and not pay them!0 -

No, it is not law. If you think it through it can't be as there is no legal obligation to have either of those documents.
However that doesn't stop an employer having their own rules. They do have a legal obligation to verify the identity and right to work in the UK.
The problem is they could just terminate his employment as he has no protection against unfair dismissal. They would have to find a way to pay him for any work done so far plus any notice pay as he would obviously win a legal claim for this but that doesn't really get him very far.
I would draw their attention to the link in the post above and take it from there.0 -
If they have already verified his right to work in the UK, which I assume they have as he has worked for two weeks, then all they need to pay him is a sort code and account number.0

He is fed up,they have told him to go to the library near where he works, and join to get a photo ID!!!!He will be handing in his notice, very unprofessional. Thanks for all the replies.I have sent them an e-mail quoting the government web site.0

How silly to give up a job for the sake of photo id that would probably make his life easier anyway.:heartsmil When you find people who not only tolerate your quirks but celebrate them with glad cries of "Me too!" be sure to cherish them. Because these weirdos are your true family.0

Make sure he gets his wages from them though. It sounds like they're just trying to find a way of not paying him0

I've never been asked to show an employer my bank card, that sounds pretty dodgy to me
And now they are refusing to pay him...what sort of company is it? Are you sure it's not some sort of scam?0
