Hi all, similar to another thread on the forum (user hh1 sorry unable to post links as only just joined) I have been given a PCN for stopping at 233 High Street UB8 1LD. I am unable to post a link to the letter as a new user but here is the alleged offense -
Parking Direct Uk Ltd have obtained your details from the DVLA as the registered keeper of this vehicle through the reasonable cause request of pursuing an outstanding parking charge. We believe that a parking charge is payable with respect to the above vehicle for the following alleged contravention: Stopping or waiting where stopping or waiting restrictions are in force at a location which had the terms of parking clearly displayed on the warning signs. On 27/06/2014 you were the registered keeper of the motor vehicle with Vehicle registration Number XXXX when the vehicle was believed to be stopping or waiting at r/o 233 High Street, UB81LD at 16:52 which resulted in the issue of the PARKING CHARGE NOTICE REF No: *****
I have read through the feedback given to the other user on the forum and was going to send the following letter to them to evoke the appeal process and get a POPLA reference -
Dear ParkDirect,
I am the registered keeper vehicle registration number and wish to invoke your appeals process for the parking charge notice reference number xxxxxx dated xxxxxx .
I deny all liability to pay this parking charge on the following grounds:
Park Direct signage is non-compliant with the British Parking Associations's Code of Practice and no contract was made with the driver.
The parking charge notice issued does not specify a particular contravention and the photographic evidence provided cannot be corroborated as evidence that the driver breached any contract on that day.
The parking charge notice issued is flawed under the requirements of POFA and does not name the creditor nor offer a discount payment amount as stipulated by your code of practice.
The parking charge is disproportionate, punitive and does not reflect a genuine pre-estimate of loss to your company or the landowner for the alleged contravention.
As you are aware POPLA have upheld all appeals where this is raised and I invite you to cancel this parking charge now. However should you deny this appeal, then please issue a POPLA code for the next stage of the appeals process. Failure to supply a POPLA code will result in formal complaints being made to the BPA and the DVLA.
Further appeal points will be raised at POPLA for consideration which will include the unredacted contract with the landowner being requested. Please be aware that should you continue to pursue me, then I reserve the right to raise a claim for my time (court rate £18.00 per hour) and to recoup all associated expenses. The expenses I may claim are not exhaustive, but may include stationery, stamps, travel and legal expenses and by continuing to pursue me, you agree to pay these should I prevail.
Yours faithfully

registered keeper.
At this stage do I need to do anything else or will this suffice. Judging by a future thread from the hh1 user who faced a similar PCN as mentioned earlier I imagine this will get rejected and then its on to the next stage with POPLA which again I would appreciate guidance on when we hit the juncture.
Appreciate all help with this as I am newbie and want to make sure these cowboys do not get away with this.
Thanks for your help

You could try copying the landowner in on this:
With something like this ( although it may need a little adjustment:
To the Landowner /car park owner:
on the <DATE> my vehicle visited <Site>, and a few days/weeks afterwards I was issued with a charge notice from your agents, Park Direct stating this:
Parking Direct Uk Ltd have obtained your details from the DVLA as the registered keeper of this vehicle through the reasonable cause request of pursuing an outstanding parking charge. We believe that a parking charge is payable with respect to the above vehicle for the following alleged contravention: Stopping or waiting where stopping or waiting restrictions are in force at a location which had the terms of parking clearly displayed on the warning signs. I Deny any liability to your agents park direct, amongst other things their signage is not compliant with their own trade association, the British Parking Association limited's code of practice and the amount demand does not represent a true genuine pre-estiamte of loss.
As you are the landowner/carpark owner and the Parking company are your Agents, I Expect you as Principal to liaise with your agents and cancel this parking charge with immediate effect.
If you do not cancel this action and insist on allowing your agents to pursue this matter upto POPLA ( Parking on private land appeal service) then I may claim my costs in full from you should a challenge to POPLA be successful.
Further more should POPLA uphold my challenge (to your agents actions), then You as principal may also be liable to refund all motorists who have paid your agents park direct, as you are responsible for their actions a compliant will be made to trading standards.
I would also like to see you take some positive action to ensure that this situation does not and will not arise again.
Yours

Great thanks so much for this. Will send a letter to them as well.
Really don't want to give these cowboys a penny for a very unjust parking ticket!
Thanks0 -

Hi all, thanks for all the help I have been given so far it is really appreciated. Following my request to appeal the alleged PCN, ParkingDirect have rejected my appeal and provided me with the POPLA code.
I wanted to upload a link to the rejection letter (personal details edited out) they have sent but am unable to post links, is it possible to get my status changed so I can include this?
Appreciate if this could be changed as I would really like some advice on next steps as I am a bit concerned by their counter arguments.
Many thanks

Hi all, thanks for all the help I have been given so far it is really appreciated. Following my request to appeal the alleged PCN, ParkingDirect have rejected my appeal and provided me with the POPLA code.
Their letter back to me states reasons why my appeal was rejected and I am a little nervous this will mean I have to pay the fine but have faith based on other postings on the forum
The following links take you to the aforementioned letter I have been sent along with the images they included -

As they are stating the driver was at fault for stopping and dropping passengers off I was not totally sure if an appeal will be withheld by POPLA, so would appreciate any advice on this as well as where to start with the appeal to POPLA - what information I would need to provide, do I need to send pictures of the of the area/signage? Any advice is greatly appreciated to not let these bullies win!
Thanks

Not difficult to find this seeing as it's linked under 'How to win at POPLA' in the NEWBIES top sticky thread!

fine ? , which fine, I cannot see any evidence in your posts of a judge or court of law having actually fined you ?
you have received an invoice demanding payment, I agree with that, plus its dressed up as an official pcn , a parking charge notice, but its most definitely NOT a "fine"
doesnt really matter what they are stating, all that matters is that as the appellant you defend yourself by making an appeal based on legal arguments as linked by post #3 of the NEWBIES sticky thread
its the lack of dissecting that sticky thread that is holding you back, plus not getting your head around the rules of this game, or its terminology
once you understand the game, and the words used, you can try to score a goal and win0 -
