Of course they apply. The upgrade puts the consumer on a new contract with new terms.
People come on this forum for money saving help, and consumer advice in confusing situations not for unhelpful blanket statements which offer no relief to anyone reading this thread.

There is no new contract, its a new minimum term of the same contract, with the potential for different terms allowed under the same contract as long as the upgrader is informed of these variable at point of upgrade e.g. sent new terms and conditions to which they must agree.

Please tell us which companies you are basing uprgrade to mean contract extension on, Vodafone obviously don't adhere to it but you must have experience..
I would still say that distance selling does apply, and if the consumer cancelled within 7 days then they would be of course bound to the terms of their previous commitment if it was still in effect.0 -

When you take an upgrade you may need to accept new terms and conditions but this is not a new contract as the existing contract allows for a variation of terms.
There is an exclusion in DSR for services which have already begun and clearly the OP has used the service.
(Of course, whether they have accepted the handset is another matter)0 -

I think your last sentence says it all, they are providing goods as well as services. How is this written into the contract, they are obviously separated if the services are allowed to start before you receive the goods.
This is obviously a flaw in DSR if this is the case, I hope it is amended.0 -
