Try this. I will add though that the vehicle genuinely is permitted to be on site, but they don't know that.:What should I put in the email Atilla?
Just the above? i didnt receive post as id moved house, cant remember the details from january? etc?
In reference to the speculative invoice TCxxxxxxx, dated xx/xx/2014, the keeper denies all liability to your company as it is an unlawful punitive charge, thus a penalty! If you reject this challenge the keeper requires within 35 days a popla verification code for them to appeal independently, as per Version 3 of the BPA Code of Practice.
The vehicle and driver were entitled to be on site and we are not at liberty to disclose to outside parties reasons why. However, if you can provide contractual evidence to show you have a legal right to this information we expect you to include this in any reply.
The keeper has nothing further to add, and will not respond to any generic correspondence from your company unless it contains the popla code and the above mentioned contractual evidence, furthermore the keeper is fully aware that you must pay £27+Vat for this, so don't forget!
The challenge will be deemed accepted if there is no popla code on any rejection that you supply within the time-frame stipulated above.
If i really can't be bothered, i send them any old pony and tell them so.0 -
@atilla, I like the belligerent approach you've adopted. Good work. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Am I allowed to send them a charge back?? Lol!
Would that work? I'm happy to copy and paste it but even with all the other threads I've read I'm completely baffled! - I'm not 'blond', but I am quite out if my depth :-/0 -
No don't send them a charge - it won't work.
Either use the version by atilla or simply send Smart the template in the Newbies thread. Hardly difficult...can't see why we are on post #25 when there's a sticky thread with a template appeal already written for everyone at the top of this forum board. It doesn't need all this discussion; this is simple. Did you miss the template I wrote for EVERY case that's in the Newbies sticky thread? This is only Smart Parking and they usually cancel even when they get a late appeal that clearly was spoon-fed from a forum. Just submit it online to Smart using the appeals page mentioned in the first Notice.
Then complain to Asda like loads of people have done - Store Manager only, not the fob-off-merchant on the CS desk, not the 'Duty Manager' dragged away from the meat counter to shut you up.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I did miss the Template .... Obviously.
Post #26 just for you coupon mad.
Im only asking for advice, I'm not an expert in this like you guys. I would apologise for boring you with the thread, but I've found it useful until now.
Thanks for your time!0 -
Hey Illi00 - I'm following your thread with interest. I have also read through the newbie stickies, but have still started my own thread to ensure I'm not messing something up. There's nothing at all wrong with asking for advice - that's what these forums are for in part! Especially if you're anxious and just need reassurance. It's quite nervewracking getting letters from debt collectors isn't it?
I also found the volume of information regarding parking tickets rather overwhelming, so you're not the only one. Just send the appeal off and see what happens.0 -
Thanks Evil Sheep

I have my email ready to send, hope it works!
Thanks everyone for your help

Good news. It is always with putting in a late appeal with Smart.Newbie thread: go to the top of this page and find these words: Main site > MoneySavingExpert.com Forums > Household & Travel > Motoring > Parking Tickets, Fines & Parking. Click on words Parking Tickets, Fines & Parking. Newbie thread is the first post. Blue New Thread button is just above it to left.0
