Apologies, seems I was confused.
The letter we received was the NTK, but there was no reference to our appeal or POPPLA.
So they are now saying we owe 120 and asking for the driver to be named.
I will give them a call tomorrow0 -
NO!! Never phone a PPC or any of their agents (e.g. debt collectors). You'll get nowhere, and may end up saying something you regret. Only communicate in writing, where you then have a paper trail.Kentish_man wrote: »I will give them a call tomorrow0 -

I had something similar. Because you have a lease entitling you to park in the space and there's no contract between you and the PPC, they have no right to the money. Also, the purpose of having the PPC there is to go after people who obviously abuse the parking there, not people visiting residents, so if they continue hounding for the money, which they will, they are just being total parasites.
In my case, I complained to the management company for the development and they promptly cancelled the PCN. I see others have also advised you to do this. Don't hesitate.

How can the NTK be asking for £120 when the maximum allowed by the BPA is £100? Keep that point in your back pocket for POPLA stage at the moment. As is the fact it comes from a third party so it confuses you re who to appeal to and who is the creditor. What does the wording say where it says the driver must be named? Are you sure the rejection letter from the PPC isn't in your junk email folder?
Just re-send the appeal, this time to PCS and enclose a copy of the acknowledgement and say 'we haven't had a reply yet - give us our POPLA code'.

Thanks to all for the assistance.
To clear a few bits up the correspondence so far:
2nd August - PCN placed on Windscreen by PTL
15th August - online appeal sent. Appeal included email evidence from landowner that stated the car bay shouldn't be policed.
4th September - NTK from PCS sent to registered keeper of vehicle. Letter dated 2nd September
To paraphrase, the NTK says that PCS obtained the details of the keeper from the DVLA, under a reasonable cause request. That the car was in breach of terms and conditions as stated by the signs on land that the vehicle was parked on which is managed by PCS's client PTL.
It goes on to say that £120 is to be paid to PCS,or they will pass it on to debt collectors after 28 days.
After advice not to ring either company, I will await further response from PTL re the appeal as tomorrow is 14 working days from the time the appeal was sent.0 -
You may have to wait longer than 14 days to hear from appeal.
Technically speaking a PPC should send a NTK 28-56 days after incident if they want the option further down line to go after the keeper for the PCN. S if the driver fails to pay and they have sent a compliant NTK, then it is possible they could chase you if they have reasonable cause to believe they cannot contact driver. Eg if driver gave false name and address.
At least that is what I think I have understood from some other of Coupon-Mad's posts on a few IA s threads I have seen recently.
So oddly enough the PPC have done it right.
Of course they may be pretending they never received the appeal from the driver.

Please keep us informed, my bet is that they will cancel. If they do, try to get a few more, in your own space at first, and them in communal areas and see what they do.
You have an opportunity to cause them some grief, seize it.You never know how far you can go until you go too far.0
