Hi
I purchased a car paid £500 deposit on credit card and the rest cash when we picked it up. Since getting the car we've found out the milage is incorrect in 2009 milage was 42000 then in 2010 it was 8000 and now it's 61000 the milage which was stated when advertised and what's on our receipt. We suspect the dashboard was changed around 2009 and the milage was never corrected. I've got a feeling the dealer is going to fob us off so was wondering if section 75 a way to go.

Be carefull of using the word clocked, if you did a .GOV mot checker search it could be a simple case of a MOT tester entering 8000 instead of 48000. and the car is accurate according to its miles, and its document record not accurate.Hi

Yes I did look at that but in 2009 42000 2010 8000 miles 2011 19000 2012 38000 2013 49000 2014 current milage 62000 so I make it's real milage approx 112000 miles at present0

Anything else wrong with the car?
Does it have an odometer underneath the car?
Has the engine been changed?
Are you prepared to pay for a specialist report to confirm your findings if you pursue a s75 claim?
They are almost certain to ask for one (you should be reimbursed if you win your claim) for a claim.0 -
Why would a report be needed if the actual mileage is about twice as much as stated and this can be proven without a report?0

Not sure on odometer under car nor can I tell if engines been changed. It's a renault grand scenic and I suspect dash was changed around 42000 miles and the replacement had 8000 on it and was never changed to actual milage. Obviously all this found out after purchase ( I trusted dealer was correct with his info) . I'm going to phone renault as all previous services were done at there shop and they may have repaired dash.0 -

You need to give the deal the chance to deal with the issue.
Both legally, morally and your credit card comapny will demand it.
You can't just ignore them because you have a feeling about their response.
Write them a letter.
Explain what the issue is and what you expect them to do.
Deliver it by hand if that's practical or post recorded delivery.
Start keeping a diary of all communication.
When did you pick up the car?
Are you in time to reject it?0 -

Picked the car up Friday tea time called the sales man on Saturday explains issue. He's told me to call Tuesday when boss is back. I'm going through the car sales first. Just wanted to know if section 75 would help if hd dosent want to know0 -
There's also 3 months warranty on the car but that would be void as milage is incorrect0

I would reject the item but do it quick, don't get fobbed off my "boss is back next week". You don't need the boss to be in to get a letter delivered.
If you wait months it will go against you. See here for info.

Yes your credit card company should help you, but they usually expect you to have tried to sort out the issue directly first.
It may take many months for the card company to sort out your claim and it may be inconvenient to not use the car for that time and you might sabotage your claim if you do nothing else so whilst the credit card company should help you it's not something you should see as an easy option. It's the last port of call not the first.0 -
