Bear in mind the exclusion clause in their returns policy:
2.1 Mobile phones must not have been used i.e. had the SIM card inserted, been activated on a cellular network, been connected to the Internet or had user accounts set-up.

The returns policy is for normal phones. Yours isn't normal. You were mis-sold.0

The Advertising Standards Authority (ASA) received a complaint in 2013 regarding the advertising and sale of mobile phones on eBay by a company called ECell. The complaint consisted of two parts, 1) being that the complainant stated that the ad stated that the phones were new (but some had been opened and re-sealed) and 2) that the ad implied that the phones had UK manufacturer's warranties.
Point 1 was not upheld due to ECell arguing that they do open a sample of handsets they receive for quality assurance purposes, the ASA were satisfied that it ECell were acting in good faith when putting this practice into action.
Point 2 was upheld because although the ad didn't say that the warranties were specifically UK, they believed that the average consumer would infer that the warranty was in fact a UK one.

Obviously only point 2 is applicable to your case but the whole thing is good ammunition for you to get the handset returned and either a refund or UK replacement0 -

I agree, but were the OP to send it back under the returns policy then they would have no need to prove mis-selling. Unfortunately that option may not be open now.
I would base my rejection not on the fact that it's a grey import, but that it has no UK warranty.No free lunch, and no free laptop0
