    A. Why did you send it recorded rather than just with a (free) certificate of posting?

    B. Does the recorded status show it was delivered?
  • It was sent recorded delivery to ensure we got a signature, proof of posting certificate wouldn't prove delivery or give the signature.

    Yes, it was definitely received and signed for :-)

    So where do I go from here?

  • Appreciate everyone's advice here.

    I've returned home to a letter from the debt recovery company. My letter (as per this forum) has obviously been passed on to them. They are explaining that the time to challenge the charge has now expired and I can no longer have access to the Independent Appeals Service. They then go on (over 4 pages) to explain why this PCN is correcty issued and must be paid.

    They refer to a ruling made in Parking Eye Ltd. v Beavis and Wardley 2014 where it was ruled that the charges incurred were enforceable.

    They have told me that sending in standard template responses from the internet will not resolve this matter and that I should take legal advice.

    They finish by saying if I don't pay in full by the 2nd December they'll advice court action and are likely not to respond to any further correspondence from me.

    As I say, really appreciate all the advice I'm getting on here but I'm really worried I've made a mistake in the process and that this could well go to court. They direct me to the ruling [I mentioned above but I cannot link to this as a new member.

    Ignore this rubbish - Beavis is an English case which they neglect to mention is still subject to an appeal. Similarly the IAS is a trade body established by PPCs for compliance with POFA 2012, so has no meaning or remit whatsoever in Scotland

    UKPC recently chickened-out of court in Scotland and the only reason they were even able to bring anyone to court in Scotland was because the victims had made the mistake of taking UKPC seriously, contacting them and confirming their identity. I'm not holding my breath for this to happen again. :)

    The very fact they have passed this to a debt collector, who can't take action against anyone not a solicitor is almost dead-cert confirmation that your "case" is going nowhere fast.

    You need to search-out some of the recent threads about UKPC at the Gallacher Retail Park across the road to see some of the other dirty tricks they have pulled this year. I'd hate you to be unprepared for a call from Gordon and Noble - who again simply try to scare payment with threats of made-up "laws"

    Another year and another letter!

    They are 'prepared' to reduce to £128 (from £160) if I pay in the next week, isn't that kind of them? Otherwise they say they're passing on to a solicitor and I will incur £75 on top of the existing £160 and they will start court proceedings.

    Never known a company reduce the amount at this stage, reeks of desperation and clutching at straws if you ask me, just backs up everything I'm being told on here.

    So, I guess I keep ignoring?
