Hi everyone,

Basically I've had a read through old and new threads on here about how to deal with this parking fine but I haven't got a clue what to do, so here goes.

I parked in Ravenside Retail Park Chesterfield and over stayed the allocated 2 hours, by about an hour, they have a picture of my number plate on entry and exit. This was on the 04/05/2014. I received my first letter from Euro Car Parks (I think the charge was for £70 rising to £100 if I didn't pay within 14 days) so I totally ignored it, didn't appeal or anything.

Then eventually I received a letter from Debt Recovery Plus Ltd demanding payment of £130 for the unpaid parking charge giving me 14 days to pay if not they will recommend to the creditor's solicitor that court action should be taken to recover what I owe. So again I totally ignored it and did nothing.

Now I have received a letter again from DRP saying notice of intended court action - unpaid parking charge £130 and that if I don't pay what I owe by 07/08/2014 or not agreed a payment option then they will pass the file to the solicitors recommending commencing court action against me. Then something saying 'A Court Judgement against you could affect your ability to obtain credit in the future.'

Then it gives charges like fees of £25, solicitors costs of £50 and interest of 8% per annum.

What do I do?? Do I carry on ignoring them? Ring them or send an appeal or what?? So confused on what to do now. Your help would be much appreciated!!

Many Thanks

You can safely ignore anything you receive from a debt collector. They have no legal standing to do anything other than send you free bog paper. They can't take you to court no matter what their meaningless threatogrammes may tell you. Only the parking company or the landowner can do that.

Have a read of the Sticky thread for Newbies as this has all the information you need on how to deal with the PCN itself. The advice on this website has been Do Not Ignore, Do Not Pay for the last eighteen months or so. Don't read old info, read the most up to date to get, well, the most up to date help.

Too late to appeal, and it's only toothless old Euro Car Parks anyway. Just keep ignoring, it's all lies and bluster.

Bazster is one of the experts here so do as he suggests.

It's only if you get an official LbC or MCOL do you need to worry.
    This is not one.
As Fruitcake says, read the newbie thread and the chain of expected letters.

Euro Car Parks have done court once in the last 18 months, and for all we know that may be because someone took them to court. (compare this with the 6000+ of Parking Eye)

So you really do not need to worry.
Newbie thread: go to the top of this page and find these words: Main site > MoneySavingExpert.com Forums > Household & Travel > Motoring > Parking Tickets, Fines & Parking. Click on words Parking Tickets, Fines & Parking. Newbie thread is the first post. Blue New Thread button is just above it to left.

Indeed Dee, when you see a FOI revealing that some PPC or other brought one or two court cases in a year there's no guarantee that they were even related to a fake fine, might've been something else entirely.

Here you go OP - some links to show the court activity of PPCs over the past 18 months or so. As Dee and bazster say, 'court' does not necessarily mean anything to do with parking charges.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

the thing about the debt collector letters, they are always full of threats , but its just words as they cannot actually DO anything at all, other than pass it back to the creditor

hence the ignore, ignore, ignore mantra in the NEWBIES sticky thread and about a score or more posts on here every single day

LBC or MCOL is what you watch out for, not the fodder for the blue recycling bin

So just totally ignore anything what I get in the post and don't bother trying to get the POPLA number from Euro carparks?
This is massively helpful and put my mind at ease a little.
    Thank you everyone who's replied!!
I'll keep you posted on anymore threats

Unless OP has subscribed to this thread then I doubt he'll see it. Regardless, the advice to you IS EXACTLY THE SAME.
