Hi guys !

Having spoke to Martin in the last few days about this, our MSE messiah has asked myself to post my positive cancellation experience for you all

Further to my post on the main Orange 07744 thread on the 14-06-2007, 9:42 PM

I can confirm cancellation after sending faxes & emails to :-

A couple of days later I spoke to Garry Elliott in rentention/disconnections in Darlington he says I have never used these prefixes ! I checked my bills and I have made two, Gary ( as rude as he was ) refused to cancel my account.

I made a call a few days later, disconnections & spoke to the young girl whom stipulated I did not match the 2.5% matrix, I politely contested my T&C changes and 2000% price per minute increase & stipulated the Retail Index was to what our T&C agreed to call charge changes to my account and not an matrix of 2.5% and if Orange wanted to change our T&C to include this matrix along with the Retail Index or to replace it Orange would have to give me 30 days written notice of this intended change - which ineffect would give me a second change to "OUR" agreement as per the agreed T&C at sign-up.

The girl would not budge, and I waited on the supervisor who agreed we politely deadlocked over the 2.5% matrix I did not fit into, following procedure I asked to escilate the matter to the manager - who inturn agreed the deadlock and to wait a response from my e-mails & faxes as her hands were tied due to the 2.5% " matrix ". I asked the manager to note all the above points on my account and thanked her for her time but I had to escilate my way up to confirm deadlock on the matter.


A week later Orange customer care e-mail back to say I have to pay the remaining months off before PAC issue, I ignored it. Two departments down, one to go.

Last week I thought my Orange bill had arrived, opened it and the request for my account closure had been processed - a standard PAC letter about leaving Orange, called customer care and they said there was no charges other than my monthly charges up to the day my number PAC's out.

The really interesting part ? ?...............

I had less than 3 minutes of 07744 since August 2006 on my account ( my sister called just saying call me back when I was abroad ).

This 2.5 % matrix is a sham and cannot be inforced by Orange, its a change to T&C over the Retail Index term & the price rise effectively is a 2000% a minute with the 07744 minutes removal - two term changes !

Usage of 07744 numbers or not is obviously here nor there or even @ 2.5% or else Orange would have enforced a right to lock my account to them until contract expiry time. If you took a contract to make use of 07744 at any time within your minimum contract period I suggest you copy/paste the following letter ( editing your details in ) to Orange requesting your PAC, if they say its too late since they notified you of the change advise them that disconnections told you your account was excluded from the 2.5% " matrix " and this was dishonest on thier part as that would require a 30 day notifiable T&C change from Orange to include/change the Retail Index term as per your original T&C agreement.




To whom it may concern,



I " bla bla "( hereon refered to as " I " ) hereby give full & immediate notice of of my intention to cancel my current Orange Personal Communications Services Ltd ( trading as Orange ) account for the mobile phone service pertaining to 07XXXXXXXXX.

I now have confirmation from the Orange press office that ALL Orange tariff's regardless of when they were taken out or what package they are, will no longer include calls to 07744 numbers.



CHANGE OF T&C

" Your Anytime Any Network Minutes include UK calls to Orange phones, standard UK landlines (those beginning with 01/02), other UK mobile networks and Orange answerphone. Calls to 08 and 09 numbers are not included in bundle and will be charged up to a maximum of 35p/min and £1.70/min or per call for 09 numbers. See the price guide for details. Calls to 07744 and 07755 numbers are not included in bundle and will be charged at a flat rate of 20p/min "

As this now is now officially confirmed by Orange Press Office and under our agreement of T&C's

4.3 You may also terminate your Contract if we vary its terms, resulting in an excessive increase in the Charges or changes that alter your rights under this Contract to your detriment. In such cases you would need to give us at least 14 days written notice prior to your Billing Dates(and within one month of us telling you about the changes). However this option does not apply if: 4.3.1 we have increased the Charges by an amount equal to or less than the percentage increase in the All Items Index of Retail Prices published by the Central Statistical Office in the Monthly Digest of Statistics in any 12 month period

" I " am now implementing my rights without futher delay to cancel under section 4.3 of the terms & conditions " I " and OPCS Ltd as both parties of the said agreement agreed to at my contract commencment date, under the change of terms OPCS Ltd propose removal of 07744 mobile prefix calls from my/our contract/agreement, my acceptance of this change which would then disallow my " Anytime Any Network Minutes " to call another UK mobile network starting with a 07744 prefix( Inquam Telecom mobile prefix as released, registered & regulated by the UK Telecommunications Regulator OFCOM ) and futhermore accept a per minute current price charge of 0.00 pence per minute rising to 0.20 pence per minute, of which is increasing my call charges by 2000%, way above the All Items Index of Retail Prices OPCS Ltd refer to also in Section 4.3 of our agreement.


" I " duly refuse to accept the proposed changes to our T & C in the matter OPCS Ltd wish to refuse access to said 07744 numbers from my current " Anytime Any Network Minutes ", futhermore a misleading " Anytime Any Network Minutes " is a breach of the Trade Descriptions Act if indeed OPCS Ltd further advertise such a description while not including the Inquam mobile 07744 prefix - as per the regulatory body Ofcom stating 07744 prefix is a UK mobile prefix, further use of such advertising by OPCS Ltd could see OPCS Ltd in severe trouble with the appropriate governing bodies & should be stopped with immediate effect. OPCS Ltd other proposal is that " I " then accepting the above change of T&C's & except a 2000% price increase per minute in relation to calling a Inquam Telecom mobile prefix.

" I " request closure of my account in the way of OPCS Ltd providing myself a PAC as soon as possible.
With thanks for your time & attention, I look forward to your further corrospondence confirming the aforementioned account closure commencment and PAC issued.

    i work at a phone shop, i had a lady come in mad about this i tried to explain this to her she would not listen to me and i told her about this web page i hope she has read this and helps her out

    But some customers tend to be very annoying and wont even let you get a word in allthought your trying to help....

    She had been told her cashback was automatic which was incorrect which wouldnt be off the sales consultants back and then i told her she did sign papers showin that she knew wat to do to claim her money ....Its just stupid to buy a contract and never read any of the papers ....

    Then she said ahhh the guy sold it like this like that no one else tried it i bought because of this this this....Every store u go to in london even at this date wen u mention it they say AAAAAAAAA its included u can use acess numbers which is just a stupid way of making sales because no customers will ever return.....

    I told her she could write a letter in and get it sorted but she would not listen to me and just went off on her own tangent .....

    I am a sales consultant i tried to help this lady but she just wanted to take her anger out of someone...i did a admins job because the admin wud have just said .....You should have read your paper work madam, also acess numbers have nothing to do with our company .....end of convo ....

    You mean you wrote that long almost unreadable draft message to send to MPs and all kinds of other irrelevant bodies, then posted it here on two separate new threads, one with a new username and website drawn up for the purpose, plus several other comments, and all about 3 phone calls in 10 months?

    I thought the point was he just wanted to cancel his contract with no penalty. This now means he can take out another contract else where.

    No redux its the principle, 0 minutes or 3 minutes or 300 a month Orange changed my T&C and charges and tried every trick up thier lawyers sleeves to get me to stay, the thread/post you refer to and username copied and pasted my original post from the main MSE Orange 07744 and i even refered them to that by PM to which I recieved no reply....I even told them in thier thread that website they created did not work via the link provided and British people would complain like hell but for the most part do nothing ( whinging pome anyone ? ). Furthermore to your comment about my draft...most legal stuff is not in plain english so most people cannot contest what they cannot understand ! The rule of law is to educate oneself about T&C & what you are signing - no company, T&C, lawyer or court will ever get a Plain English Campaign Award ( http://www.plainenglish.co.uk/mediaawards.htm ), its there to confuse & abuse you or ( empowering yourself through self education ) to protect, at 30 most my family, friends & friends of friends approach me on issues with loads of things, I'm only too glad to help and always have had a techincal mind since an early age around law and thus 50% of my life I have dealt advise out and won many battles/cases for people around me

    Exactly Poppy 2550 minutes and 10500 texts and unlimited broadband with free Orange,01 & 02 calls for 40.00 a month were extra advantages of the contract for when I would be returning abroad in the next 9 months that my account/contract still has to run till completion - my main reason for Orange was I was moving abroad ( temp delayed ) and my sister needed to contact myself cheap as possible while harrased and stalked by her violent ex partner for advise & support ( being over 20 flying hours away its not like a flight from Europe where I could/can pop home easily, never mind the expense to do so ! )

    *Remember my account closure letter and account notes from the manager in disconnections went to Orange UK's Legal and Administration depts at George St, London and even they did not contest my account closure.
    That says plenty about my legal stance with Orange's first two refusals to allow me to cancel via the T&C we both agreed to at sign up of my account/contract. Now considering I have no legal training at all ( I'm trying to enrole at uni for it at the moment as I do have natural knack of law ) I think I done quite well taking on Orange and thier Legal department and them backing down over everything they threw at me, I thought to share my experience with all the unhappy MSE'rs in the 07744 position with Orange was a good thing to do and I had Martins full approval to post my experience and how I challenged Orange to completion - CONTRACT VOIDED
