estate agent won't pass on our offer

    And in answer to those saying I should have given all my financial details, my question actually was just about whether they are obliged to pass on my offer. anselld managed to give me a useful answer without asking me for more info so thank you anselld.

    You have an AIP not a mortgage offer. Is the lender aware of the other property and the fact you intend to retain it presumably to rent? Is your existing lender agreeable to your plans and willing to grant a BTL mortgage?

    The OP has stated that they are selling the property.

    But you couldn't just explain this to the Estate Agent.

    In light of the estate agents knowing you can proceed and not passing on your offer, if the house is occupied by the owner I would knock on the door and make them an offer. I would also be suggesting to the sellers that if they accept they may want to refuse the agents commission as they are obstructing selling their house.

    25 years ago my mum wanted to buy what is now her house. The estate agent told her to come back when she had sold her house. My mum knocked on the door and they actually ended up "swapping" houses as the vendor was downsizing.

    The agents knew nothing about it. When they phoned the seller (at the house) and my mum answered she told them she had already bought the house. When they asked where the vendor was (wanting their commission of course) she said she had no idea!

    What you are saying doesn't really add up. EAs make their money by selling houses - so it's not usually in their interests not to pass on 'real' offers (as well as illegal).

    Just in case there has been a misunderstanding, explain to the EA that the purchase is not dependent on selling your existing property - and restate your offer. Perhaps do it in an email - they are more likely to take it seriously if there is an electronic paper trail.

    (The vendor's solicitor will ask your solicitor to confirm that the purchase is not dependent on a sale. So you will start digging yourself quite a big hole, if you tell fibs about this.)


    Finally, I may be wrong but it sounds like you may be being a little too 'stand-offish' with the EA. However much you might dislike the EA, if your offer is accepted you're going to have to deal with the EA on a fairly regular basis. So it's best not to make them an enemy.

The EA has never asked me where my deposit is coming from, has just insisted that they can't put forward an offer until I have an accepted offer.     If you are intending to buy the house with the proceeds of a sale that hasn't happened yet then you don't have the money....

    You either have to wait til you get a suitable offer on your place, or tell them that you are paying cash. However, that is sure to !!!! the vendors right off if you switch from no-chain to chain after they've accepted your offer.

    I think this is a bit of a grey area because our buyers hadn't sold but they decided to rent their house out so had our estate agent took this approach we wouldn't have sold.
