HELP! ive just started a new job (one shift in) and ive been diagnosed with M.E, spoken to my boss, its obvious she wants to fire my !!!/ get me to leave, if i leave or she fires me will i get any help? either through job seekers or ill health? I'm so scared to make any kind of move without knowing all the outcomes incase i loose my house or cannot afford to live
stressed and confused and feeling worse :'( i live with my other half who works 39 hours on min wage, will that make a difference?

Are you fit for work, if not JSA would not apply
Have you worked and paid NI for the tax years 11/12 and 12/13, you may be able to look at contribution based ESA if you are unable to work due health0 -
i have worked my whole life and paid tax and n.i. I havent officially been signed off from a doctor as i cant get in to see them yet. what will happen if i am either fired or signed off? *lost*0

Do you need to be signed off? A diagnosis in itself does not make you unfit for work, were you not able to cope with the first shift?
The employer cannot dismiss you for a diagnosis, they can (and probably will) dismiss you if you go off sick after one shift.0 -

Exactly this. What has changed? To get the diagnosis you must have been ill for some time. Did your new employer not know of your health issues?Lost my soulmate so life is empty.

Can you do the job, perhaps with alterations to your work to make it more possible for you.
If this is the case, then they cannot legally fire you for being disabled.0 -
ive had symptoms for years but its only just come to light, i wrote on my application muscle and joint pain under investigation, turns out ive got m.e and something else undiagnosed. i cannot strenously work for 10.5 at a time, today i said about altering/cutting back hours, they said 'thats the job, and youve only just started, i could re apply if i get better or get a sick note to them in 2 days time. Im not gonna lie the job is awful but i dont know what i can or cant claim if i have a job/dont have a job. they obviously want me to leave of my own accord but im not that stupid.0

Are you unwell at the moment, will you GP give you a fit note? If he does give you one how long are you going to need off because your employer isn't going to tolerate you being off for a prolonged if any amount of time...it's not fair to your workmates as you were obviously employed because another member of staff was needed.0

But they can dismiss for a myriad of non discriminatory reasons. Also there is no guarantee that the OP would have protection under the Equality Act, ME can vary massively in how it affects the individual and hence whether they would be classed as disabled.0 -

You must of known you were unable to work for 10.5 when you accepted the job? So why take it and now run the risk of losing it anyway? If they sack you, are you going to be able to claim JSA anyway as you will have to actively look for work and CB JSA is only payable for 6 months and with your husband working fulltime you won't qualify for IR JSA.0
