Does anybody have experience of successful PPI miss - selling claim against the BOS Prerference Card. I started my claim in late 2012 and received a final decision letter turning down by claim, they advised that I could take my complaint to the Financial Ombudsman which I did. I today heard from the Ombudsman that it was not in their jurisdiction to rule on this complaint as the card was taken out in the name of Capital Bank, now part of BOS. The card I received in 1998 was always in the name of Bank of Scotland, never Capital Bank and the Bank themselves suggested I go to the Ombudsman. Any ideas where I go from here?

Be aware that court action is rare and not known to have many successes. It will look at point of law and the PPI issue is not a legal one. A greater onus will be placed on you to prove wrongdoing in law. So, what exactly would be your reason for legal action?

Hi There
I had a Capital Bank loan taken out in around 1995 to consolidate other loans/ credit card. It had a single policy premium that I did not know would attract more interest, I was not given the full cost of the PPI, not told about cancellation and was told that I had to have the PPI as the amount was quite large (about £10000) and there was no chance of me getting it without cover. Although the advisor didnt say I had to take their cover, I had no idea you could buy such cover elsewhere. I didn't need it (good benefits from work) and explained this but she insisted a specific policy would be needed. I later had to reschedule this loan as it was just so expensive, the ppi was rolled into the reschedule and, as I know now, more interest applied to it. But I was told as it was rescheduled I would not be covered, but still had to pay for it.
I have completed a claim form, phoned Halifax and was told, yes Capital Bank is in their group and given an address to post the form to. But reading this thread, I see that FOS has no jurisdiction to intervene? Why would this be, does anyone know?
I will send in the claim anyway, as Halifax just might uphold it, but it seems that if they don't, there is nowhere else to go.

Yes. I applied for a loan 1995. During the call they advised I was eligible for a preference account. They made it sound like a bank account.
They then sent me TWO separate credit cards. I stupidly thought they were for one account and when I successfuly claimed back Ppi for the loan they refused for the cards. Even though the application was all during the same phone call. I referred the matter to the ombudsman who upheld my complaint and BOS accepted their decision. I'm just waiting on the offer. I've no idea what it could be but both cards ran from 1995 to 2005 on some silly interest rate and were maxed out.
Id go back to the ombudsman. They really helped me out.0 -
Result!!! Today I received my offer. £12846.82
I am over the moon. All that from just one lender and the one that said I had no claim.0
